The Court found that the French system contravened both Directives 95/59/EC and 92/79/EC, which lay down that manufacturers and importers may freely set the selling prices of manufactured tobaccos. It also infringed Article 90 of the Treaty, which prohibits any fiscal discrimination between similar products to the detriment of products of other Member States (almost all the cigarettes made from dark tobacco sold in France are locally manufactured, while light cigarettes are mostly imported).

The Commission has decided to send three Member States requests for information on what measures they have taken to comply with European Court of Justice rulings: the Netherlands to comply with the Court judgment of 8 November 2001 concerning an irregular VAT exemption on expenses for staff cars; Italy the judgment of 25 October 2001 concerning the repayment of VAT with securities; France the judgment of 27 February 2002 concerning the levying of a minimum price on cigarettes and differentiated taxation of light and dark tobacco.
