Major recent developments with respect to the Korean Peninsula have included the considerable steps forward in political liberalisation and economic reform in South Korea under President Kim Dae-Jung; the beginning of a thaw in inter-Korean relations with the "sunshine policy" of President Kim and his summit meeting last year with the North Korean President Kim Jong-il; and, in our bilateral relations, the coming into force on 1 April 2001 of the EU South Korea Framework Agreement and its attached political declaration, underlining the increasing strength of our economic and political relations, as well as the recent opening of diplomatic relations with the DPRK.

Notes, and considers it regrettable, that the survival of the dictatorial and repressive North Korean regime depends essentially on China; welcomes China’s responsible behaviour in voting in favour of the UNSC’s strong condemnation on 15 April 2012 of the failed rocket launch by North Korea, widely considered as an attempted ballistic missile test; looks forward to China continuing to take responsibility for stability on the Korean Peninsula, a swift resumption of the six-party talks on the North Korean nuclear threat, and, above all, a drastic improvement in the day-to-day living conditions of North Korean citizens brought about through Chinese incentives;

8. dringt er ook bij China op aan niet langer samen te werken met Noord-Koreaanse veiligheidsagenten bij het opsporen van Noord-Koreaanse vluchtelingen om hen te arresteren; verzoekt daarentegen de VRC om ngo's en verleners van gemeenschapszorg humanitaire toegang te verlenen tot Noord-Koreaanse vluchtelingen en asielzoekers in China, o.a. om hen te voorzien van voedsel, medische behandelingen, onderwijs en juridische bijstand en andere diensten;
8. Also calls on China to stop cooperating with North Korean security agents in tracing North Korean refugees with the aim of arresting them; urges the PRC instead to allow NGOs and community service providers humanitarian access to North Korean refugees and asylum-seekers in China, including for the provision of food, medical treatment, education and legal and other services;

E. overwegende dat China op grond van zijn repatriëringsovereenkomst met Noord-Korea uit 1986 Noord-Koreaanse burgers de toegang tot UNHCR-asielprocedures ontzegt, hetgeen in strijd is met het VN-Vluchtelingenverdrag van 1951 en het bijbehorende protocol van 1967, waartoe de Volksrepubliek China (VRC) is toegetreden; overwegende dat volgens schattingen van ngo's de VRC jaarlijks zo'n 5.000 Noord-Koreaanse vluchtelingen arresteert en onder dwang terugbrengt naar de DVK;
E. whereas, on the basis of its 1986 repatriation agreement with North Korea, China prevents North Korean citizens from accessing UNHCR asylum procedures, in violation of the 1951 UN Convention on Refugees and the 1967 Protocol thereto, to which the People's Republic of China (PRC) has acceded; whereas, according to NGO estimates, the PRC arrests and forcibly returns up to 5 000 North Korean refugees to the DPRK every year;

7. dringt er bij de Chinese autoriteiten op aan de Noord-Koreaanse overlopers te behandelen als vluchtelingen „sur place”, de UNHCR toegang te verlenen om hun statuut vast te stellen en te helpen bij hun veilige reïntegratie, alle overlopers die momenteel gevangen worden gehouden vrij te laten, degenen die vluchtelingen helpen op humanitaire gronden niet langer strafrechtelijk te vervolgen en met Chinese mannen gehuwde Noord-Koreaanse vrouwen de legale verblijfsstatus toe te kennen;
7. Appeals to the Chinese authorities to treat North Korean defectors as refugees ‘sur place’, to allow the UNHCR access in order to determine their status and assist their safe resettlement, to release all such defectors who are currently being detained, to decriminalise those who try to help refugees on humanitarian grounds, and to grant North Korean women married to Chinese citizens legal resident status;

169. merkt op dat het parlement van de Democratische Volksrepubliek Korea (Noord-Korea) in april 2009 de grondwet van het land heeft gewijzigd, onder meer door invoeging van de bepaling dat Noord-Korea „de mensenrechten eerbiedigt en beschermt”; dringt er bij de Noord-Koreaanse autoriteiten op aan concrete en zichtbare stappen te zetten naar verbetering van de mensenrechtenomstandigheden; verzoekt de autoriteiten in dit verband de inspectie van alle detentiefaciliteiten door onafhankelijke internationale deskundigen toe te laten en speciale EU-vertegenwoordigers toe te staan het land te bezoeken; onderstreept dat niet alleen constitutionele bepalingen maar bovenal ook de tenuitvoerlegging constructieve maatregelen in aanmerking moeten worden genomen bij de beoordeling van de mensenrechtensituatie in het land; roept de Noord-Koreaanse autoriteiten eveneens op de beperkingen op de monitoring van de voedseldistributie door internationale waarnemers op te heffen en ervoor te zorgen dat de internationale hulp terechtkomt bij de behoeftigen; dringt er bij de Noord-Koreaanse leiders op aan een constructieve mensenrechtendialoog met de EU aan te gaan;
169. Notes that in April 2009 the Parliament of the Democratic People's Republic of Korea (North Korea) revised the country's Constitution to include, among other things, a provision that North Korea ‘respects and protects human rights’, urges the North Korean authorities to make concrete and tangible steps towards improving human rights conditions, and in this respect calls on the authorities to allow inspection of all types of detention facilities by independent international experts, and to allow UN Special Reporters to visit the country; stresses that not only constitutional provisions, but above all the application of concrete measures, have to be taken into account when evaluating the human rights situation in the country; calls on the North Korean authorities to lift restrictions on international staff's ability to monitor the distribution of aid, and to ensure that international aid reaches the needy; urges the leadership of North Korea to engage constructively in human rights dialogues with the EU;
