IN-CONTEXT TRANSLATIONS

Door hun beslissing om overeenkomstig artikel 4 van het Protocol van Kyoto hun verplichtingen gezamenlijk na te komen, zijn de Unie en haar lidstaten overeenkomstig lid 6 van dat artikel en met artikel 24, lid 2, van het Protocol van Kyoto gezamenlijk verantwoordelijk voor de nakoming van hun gekwantificeerde emissiereductieverplichtingen uit hoofde van artikel 3, lid 1 bis, van het Protocol van Kyoto.
In deciding to fulfil their commitments jointly in accordance with Article 4 of the Kyoto Protocol, the Union and its Member States are jointly responsible, under paragraph 6 of that Article and in accordance with Article 24(2) of the Kyoto Protocol, for the fulfilment of their quantified emission reduction commitments under Article 3(1 bis) of the Kyoto Protocol.

In the same declaration, the Union, its Member States, Croatia and Iceland also stated, in line with Article 4(1) of the Kyoto Protocol which allows parties to fulfil their commitments under Article 3 of the Kyoto Protocol jointly, that Article 3(7 ter) of the Kyoto Protocol will be applied to the joint assigned amount pursuant to the agreement on joint fulfilment by the Union, its Member States, Croatia and Iceland and will not be applied to any Member State, Croatia or Iceland individually.

(13) The power to adopt acts in accordance with Article 290 of the Treaty on the Functioning of the European Union should be delegated to the Commission to update the definitions laid down in this Decision in the light of changes to definitions adopted by the bodies of the UNFCCC or the Kyoto Protocol or other multilateral agreements relevant to climate change concluded by the Union, to amend Annex I to add accounting periods and ensure consistency between those accounting periods and the relevant periods adopted by the bodies of the UNFCCC, or other multilateral agreement relevant to climate change concluded by the Union, to amend Annex II with updated reference levels in accordance with the proposed reference levels submitted by Member States subject to corrections made in accordance with this Decision and in the light of changes to reference levels approved by the bodies of the UNFCCC or the Kyoto Protocol, to revise the information specified in Annex III in accordance with scientific progress and in the light of changes adopted by the bodies of the UNFCCC or the Kyoto Protocol or other successor frameworks and to revise the conditions relating to the accounting rules for natural disturbances laid down in this Decision in the light of scientific progress or to reflect revisions to acts adopted by the UNFCCC or Kyoto Protocol bodies.

12. onderstreept dat binnen de huidige operationele structuur van het Protocol van Kyoto de noodzaak bestaat van gekwantificeerde verplichtingen inzake emissiebeperking of -reductie (QELRO's), die in mei 2012 door de partijen zouden worden ingediend en tijdens de Conferentie van Doha als wijzigingen van het Protocol van Kyoto zouden worden aangenomen, overeenkomstig Besluit 1/CMP 7; verzoekt de in bijlage B opgenomen partijen hun QELRO's in te dienen zo zij dit nog niet hebben gedaan, en is verheugd over hetgeen de EU in eerste aanleg heeft ingediend; benadrukt dat overdracht van toegewezen eenheden (AAU's) naar de tweede verbintenisperiode de integriteit van het Protocol van Kyoto zou ondermijnen; wijst erop dat het Protocol van Kyoto geen werkelijk effect op klimaatmitigatie zal hebben als de lidstaten AAU's mogen overdragen;
12. Emphasises, within the current operational structure of the Kyoto Protocol, the need for quantified emission limitation or reduction objectives (QELROs), which were due to be submitted by the Parties by May 2012, to be adopted as amendments to the Kyoto Protocol at the Doha Conference, in accordance with Decision 1/CMP.7; calls on those Annex B Parties which have not yet done so to submit their QELROs, and welcomes the initial EU submission in this regard; stresses that the carry-over of assigned amount units (AAUs) to the second commitment period would undermine the integrity of the Kyoto Protocol; points out that if Member States are allowed to transfer AAUs, the Kyoto Protocol will have no real effect on climate mitigation;

Artikel 3, lid 2, van het Protocol van Kyoto bepaalt dat de in bijlage I van het UNFCCC opgenomen partijen bij het Protocol van Kyoto in 2005 aantoonbare vorderingen dienen te hebben gemaakt bij de nakoming van hun verplichtingen ingevolge het protocol.
Article 3(2) of the Kyoto Protocol requires Parties to the Protocol included in Annex I to the UNFCCC to have made demonstrable progress in achieving their commitments under the Protocol by 2005.

4. betreurt dat de EU niet streeft naar een spoedige ratificatie om zo het momentum en het krachtige leiderschap dat de EU terzake in het verleden heeft getoond, niet te verliezen; steunt in dit verband de conclusies van de Europese Raad van Keulen in juni 1999 die de wens van de Europese Unie beklemtoonde om de in Kyoto gedane toezeggingen na te komen en energiek aan te dringen op het scheppen van voorwaarden voor spoedige ratificatie van het Protocol van Kyoto in het kader van in Buenos Aires goedgekeurde actieplan; is eveneens verheugd over het feit dat de mededeling het belang beklemtoont van het bereiken van overeenstemming over een tijdschema en een streefdatum voor gelijktijdige ratificatie van het Protocol door de lidstaten; verzoekt de Raad derhalve, tijdens de volgende zitting van de Milieuraad op 12 oktober 1999 zijn Werkgroep ad hoc inzake klimaatverandering te verzoeken een tijdschema op te stellen van de nodige maatregelen voor een spoedige ratificatie door de lidstaten en de EU-instellingen begin 2000;
4. Deplores the failure of the EU to move towards speedy ratification if the momentum and the strong leadership shown by the EU on this issue in the past are to be maintained; in this context, endorses the conclusions of the June 1999 Cologne European Council, which emphasise the desire of the European Union to fulfil the commitments undertaken in Kyoto and to press vigorously for the creation of conditions for speedy ratification of the Kyoto Protocol under the Action Plan adopted in Buenos Aires; also welcomes the fact that the Communication highlights the importance of reaching agreement on a timetable and a target date for simultaneous ratification of the Protocol by Member States; asks therefore that the Council, at its next environment meeting on 12 October 1999, request its Ad Hoc Group on climate change to prepare a timetable of actions required for early ratification by the Member States and the EU institutions in early 2000;
