Na de bijwerking van de tekst door de juristen-vertalers heeft de Raad op 9 december 2014 zijn standpunt vastgesteld volgens de gewone wetgevingsprocedure in artikel 294 van het Verdrag betreffende de werking van de Europese Unie.

2. De redelijke vergoeding is alleen verschuldigd indien de eiser, hetzij bij de persoon die de uitvinding toepast, hetzij bij het Bureau een vertaling van de conclusies heeft ingediend die het Bureau voor het publiek toegankelijk heeft gemaakt, in de officiële taal van de lidstaat waar degene die de uitvinding toepast, is gevestigd of zijn zetel heeft of, wanneer die lidstaat meer officiële talen heeft, in de door die persoon aanvaarde of aangewezen taal, mits de betwiste toepassing volgens de originele tekst van de aanvrage en volgens de tekst van de vertaling een inbreuk op de aanvrage vormt.
2. Reasonable compensation shall be due only if the applicant has either communicated to the person using the invention or filed with the Office a translation of the claims which the Office has made available to the public and which is in the official language of the Member State in which the person using the invention has his residence or principal place of business or, where that State has more than one official language, in the language which that person has accepted or designated, provided that the contested use constitutes infringement of the application according to the original text of the application and according to the text of the translation.

De laatste zin van artikel 11, lid 2, van de voorgestelde verordening, waarin wordt bepaald dat een vertaling niet nodig is indien de veronderstelde inbreukmaker de tekst kan begrijpen, moet voorkomen dat de geadresseerde misbruik maakt van zijn recht op een bepaalde vertaling. Niettemin ligt de bewijslast ook in dat geval bij de eiser.
The last sentence of Article 11(2) of the proposed Regulation, which provides that no translation shall be necessary if the suspected infringer understands the text, is intended to ensure that the addressee does not misuse his right to a particular language. In this case, too, the burden of proof nevertheless rests with the applicant.

De tekst bepaalt immers dat de conclusies van het octrooi - in feite het kortste, maar het belangrijkste deel, omdat daarin de grenzen van de bescherming worden vastgelegd - moeten worden vertaald in alle officiële talen van de EU. In dit stadium slagen de Europese ministers er echter niet in een compromis te vinden over de vraag wie zal beslissen over de rechtsgeldigheid van de vertaling en hoe de gevolgen van een foutieve vertaling zullen worden opgevangen.
The text does in fact stipulate that the claims in the patent - this being the shortest but most important section as it defines the limits of the protection - should be translated into all official EU languages. As things stand at present, the European ministers are unable to agree on a compromise regarding the issue of knowing who will decide on the legal validity of the translation and how to deal with the effects of a mistranslation.
