Deze richtlijn is van toepassing op alle geplande, bestaande of noodsituaties waarbij een risico van blootstelling aan ioniserende straling bestaat dat niet kan worden verwaarloosd vanuit het oogpunt van de stralingsbescherming of vanuit het oogpunt van de milieubescherming met het oog op gezondheidsbescherming op lange termijn.
1. This Directive applies to any planned, existing or emergency exposure situation which involves a risk from exposure to ionising radiation which cannot be disregarded from a radiation protection point of view or with regard to the environment in view of long-term human health protection.

8. Deze richtlijn doet geen afbreuk aan de toepassing van Richtlijn 96/29/Euratom (21) van de Raad van 13 mei 1996 tot vaststelling van de basisnormen voor de bescherming van de gezondheid der bevolking en der werkers tegen de aan ioniserende straling verbonden gevaren noch aan die van Richtlijn 97/43/Euratom van de Raad van 30 juni 1997 betreffende de bescherming van personen tegen de gevaren van ioniserende straling in verband met medische blootstelling (22).
8. This Directive shall not affect the application of Council Directive 96/29/Euratom of 13 May 1996 laying down basic safety standards for the protection of the health of workers and the general public against the dangers arising from ionising radiation (21), nor of Council Directive 97/43/Euratom of 30 June 1997 on health protection of individuals against the dangers of ionising radiation in relation to medical exposure (22).

Richtlijn 96/29/Euratom van de Raad van 13 mei 1996 tot vaststelling van de basisnormen voor de bescherming van de gezondheid der bevolking en der werkers tegen de aan ioniserende straling verbonden gevaren , is onder meer van toepassing op het vervoer binnen, de invoer in en de uitvoer vanuit de Gemeenschap van radioactieve stoffen en behelst een rapporterings- en vergunningverleningssysteem inzake praktijken met betrekking tot ioniserende straling.
Council Directive 96/29/Euratom of 13 May 1996 laying down basic safety standards for the protection of the health of workers and the general public against the dangers arising from ionising radiation , applies, inter alia, to the transport, import to and export from the Community of radioactive substances and provides for a reporting and authorisation system of practices involving ionising radiation.

(13) Overwegende dat deze richtlijn eisen moet bevatten betreffende het ontwerp en de vervaardiging van hulpmiddelen met ioniserende straling; dat zij geen afbreuk doet aan de toepassing van Richtlijn 96/29/Euratom van de Raad van 13 mei 1996 tot vaststelling van de basisnormen voor de bescherming van de gezondheid der bevolking en der werkers tegen de aan ioniserende straling verbonden gevaren (8);
(13) Whereas this Directive should include requirements regarding the design and manufacture of devices emitting ionizing radiation; whereas this Directive does not affect the application of Council Directive 96/29/Euratom of 13 May 1996 laying down basic safety standards for the protection of the health of workers and the general public against the dangers arising from ionising radiation (8);

Overwegende dat in de onderhavige richtlijn eisen dienen te worden geformuleerd voor het ontwerp en de fabricage van hulpmiddelen die ioniserende straling uitzenden; dat deze richtlijn geen afbreuk doet aan het vergunningsvereiste van Richtlijn 80/836/Euratom van de Raad van 15 juli 1980 houdende wijziging van de richtlijnen tot vaststelling van de basisnormen voor de bescherming van de gezondheid der bevolking en der werkers tegen de aan ioniserende straling verbonden gevaren (9) en ook geen afbreuk doet aan de toepassing van Richtlijn 84/466/Euratom van de Raad van 3 september 1984 tot vaststelling van fundamentele maatregelen met betrekking tot de stralingsbescherming van personen die medisch worden onderzocht of behandeld (10); dat Richtlijn 89/391/EEG van de Raad van 12 juni 1989 betreffende de tenuitvoerlegging van maatregelen ter bevordering van de veiligheid en de gezondheid van werknemers op het werk (11) alsmede de bijzondere richtlijnen die daarop betrekking hebben, van toepassing moeten blijven;
Whereas this Directive should include requirements regarding the design and manufacture of devices emitting ionizing radiation; whereas this Directive does not affect the authorization required by Council Directive 80/836/Euratom of 15 July 1980 amending the Directives laying down the basic safety standards for the health protection of the general public and workers against the dangers of ionizing radiation (9), nor application of Council Directive 84/466/Euratom of 3 September 1984 laying down basic measures for the radiation protection of persons undergoing medical examination or treatment (10); whereas Council Directive 89/391/EEC of 12 June 1989 on the introduction of measures to encourage improvements in the safety and health of workers at work (11) and the specific directives on the same subject should continue to apply;

11.5.3. Hulpmiddelen voor radiotherapie die ioniserende straling uitzenden, moeten zodanig zijn ontworpen en vervaardigd dat een betrouwbare bewaking van en controle op de toegediende dosis, het type straling en de energie en, indien van toepassing, de kwaliteit van de straling mogelijk zijn.
11.5.3. Devices emitting ionizing radiation, intended for therapeutic radiology shall be designed and manufactured in such a way as to enable reliable monitoring and control of the delivered dose, the beam type and energy and where appropriate the quality of radiation.
