TRADUCTIONS EN CONTEXTE

In spoedeisende gevallen, wanneer het ontbreken van maatregelen onherstelbare schade zou veroorzaken aan het bedrijfsleven van de Unie en ingeval de Commissie, op eigen initiatief of op verzoek van een lidstaat, constateert dat aan de voorwaarden van artikel 12, leden 1 en 2, is voldaan en van oordeel is dat voor een bepaalde, in bijlage I genoemde categorie producten waarop geen kwantitatieve beperkingen van toepassing zijn, een kwantitatief contingent, voorafgaand toezicht of toezicht achteraf moet worden ingesteld, is de in artikel 32 vastgestelde procedure van toepassing op de in artikel 12, lid 3, bedoelde gedelegeerde handelingen teneinde de invoerregeling voor het betrokken product te wijzigen, onder meer door de bijlagen bij deze verordening te wijzigen.
In cases of emergency where the absence of measures would cause irreparable damage to the Union industry, and where the Commission finds, upon its own initiative or on the request of a Member State, that the conditions set out in Article 12(1) and (2) are fulfilled, and considers that a given category of products listed in Annex I and not subject to any quantitative restriction should be subject to quantitative limits or prior or retrospective surveillance measures, and therefore imperative grounds of urgency so require, the procedure provided for in Article 32 shall apply to delegated acts referred to in Article 12(3) in order to alter the import rules for the product in question, including by amending the Annexes to this Regulation.

Subject to the measures in force in the Union relating to double checking systems and to prior and retrospective surveillance of textile products on importation into the European Union, binding tariff information issued by the customs authorities of Member States which is not in accordance with this Regulation, may continue to be invoked for a period of 60 days, under Article 12(6) of Regulation (EEC) No 2913/92.

Het is dienstig te bepalen, overeenkomstig artikel 12, lid 6, van Verordening (EEG) nr. 2913/92 van de Raad van 12 oktober 1992 tot vaststelling van het communautair douanewetboek (2), dat de houder van een door een douanedienst van een lidstaat afgegeven bindende tariefinlichting over de indeling van goederen in de gecombineerde nomenclatuur daarop nog 60 dagen een beroep kan doen indien deze niet in overeenstemming is met onderhavige verordening, met inachtneming van de in de Unie geldende bepalingen inzake de dubbele controle en het voorafgaand toezicht en het toezicht achteraf op de invoer van textielproducten in de Unie.
