54. stelt vast dat na de G20-Top van 2 april 2009 offshore financiële centra hebben toegezegd de OESO-normen op het gebied van transparantie en uitwisseling van informatie te zullen gaan hanteren; wijst er echter op dat de schadelijke structuren van belastingparadijzen nog altijd aanwezig zijn; roept nogmaals op tot actie buiten het OESO-kader ter bestrijding van belastingparadijzen, met het oog op de uiteenlopende tekortkomingen hiervan; spreekt in verband hiermee nogmaals zijn bezorgdheid uit over het feit dat op grond van de internationale normen van de OESO informatie-uitwisseling op verzoek verplicht is, maar dat er geen automatische informatie-uitwisseling is als in het kader van de belastingrichtlijn voor spaartegoeden; bekritiseert ook het feit dat de OESO toestaat dat regeringen aan plaatsing op haar zwarte lijst ontkomen louter door te beloven de principes op het gebied van informatie-uitwisseling na te leven, zonder ervoor te zorgen dat deze principes ook werkelijk in de praktijk worden gebracht; is ook van mening dat de vereiste om een akkoord te sluiten met 12 landen om van de zwarte lijst te worden geschrapt, willekeurig is, aangezien zij geen verband houdt met kwalitative indicatoren die een objectieve beoordeling mogelijk maken van de vraag of goede bestuurspraktijken zijn gevolgd;
54. Notes that, since the G20 Summit of 2 April 2009, offshore financial centres have committed to OECD standards on transparency and exchange of information; notes however that the harmful structures of tax havens still prevail; calls once more for action beyond the OECD framework to combat tax havens in view of their various shortcomings; in this respect, reiterates its concerns about the fact that the OECD international standards require exchange of information on request but that there is no automatic exchange of information along the lines of the Savings Tax Directive; likewise criticises the fact that the OECD allows governments to escape its blacklist merely by promising to adhere to the information exchange principles, without ensuring that these principles are effectively put into practice; considers also that the requirement to conclude agreements with 12 other countries in order to be removed from the backlist is arbitrary as it does not refer to any qualitative indicators for an objective assessment of compliance with good governance practices;

Het ontbreken van een gemeenschappelijk juridisch kader voor een doeltreffende, snelle uitwisseling van informatie en inlichtingen tussen de rechtshandhavingsautoriteiten van de lidstaten is een leemte die moet worden opgevuld. De Raad van de Europese Unie acht het daarom noodzakelijk een juridisch bindend instrument betreffende de vereenvoudiging van de uitwisseling van informatie en inlichtingen aan te nemen.
The absence of a common legal framework for the effective and expeditious exchange of information and intelligence between the law enforcement authorities of the Member States is a deficiency that will have to be remedied; the Council of the European Union therefore deems it necessary to adopt a legally binding instrument on simplifying the exchange of information and intelligence.

(2) De afgelopen jaren hebben lidstaten een groeiend aantal nieuwe psychoactieve stoffen aangemeld via het mechanisme voor snelle uitwisseling van informatie dat werd ingesteld bij Gemeenschappelijk Optreden 97/396/JBZ van 16 juni 1997, door de Raad vastgesteld op grond van artikel K.3 van het Verdrag betreffende de Europese Unie, betreffende de uitwisseling van informatie, de risicobeoordeling en de controle inzake nieuwe synthetische drugs[14] en nog werd versterkt door Besluit 2005/387/JBZ van de Raad van 10 mei 2005 inzake de uitwisseling van informatie, de risicobeoordeling en de controle ten aanzien van nieuwe psychoactieve stoffen[15].
(2) During the past years, Member States have notified an increasing number of new psychoactive substances via the mechanism for rapid exchange of information which was established by Joint Action 97/396/JHA of 16 June 1997 adopted by the Council on the basis of Article K.3 of the Treaty on European Union, concerning the information exchange, risk assessment and the control of new synthetic drugs[14] and was further strengthened by the Council Decision 2005/387/JHA of 10 May 2005 on the information exchange, risk-assessment and control of new psychoactive substances[15].

(15) Voortbouwend op de relevante deskundigheid is er in het bijzonder behoefte aan passende duurzame coördinatie, op het gebied van gezondheidsvoorlichting, van activiteiten in verband met de bepaling van de voorlichtingsbehoeften, de ontwikkeling van indicatoren, de verzameling van gegevens en informatie, vergelijkbaarheidsvraagstukken, uitwisseling van gegevens en informatie met en tussen de lidstaten, voortdurende ontwikkeling van gegevensbanken, analyses en ruimere verspreiding van informatie, alsmede, wat snelle reactie betreft, aan activiteiten in verband met epidemiologische surveillance, ontwikkeling van surveillancemethoden, uitwisseling van informatie betreffende richtsnoeren en acties, mechanismen en procedures voor preventie en controle.
(15) There is in particular a need to ensure, relying on competent and relevant expertise, appropriate sustainable coordination, in the area of health information, of activities in relation to the following: definition of information needs, development of indicators, collection of data and information, comparability issues, exchange of data and information with and between Member States, continuing development of databases, analyses, and wider dissemination of information. Such coordination should also be ensured in the area of rapid reaction to health threats, of activities in relation to epidemiological surveillance, development of surveillance methods, exchange of information on guidelines and on prevention and control actions, mechanisms and procedures.

V. V. Development of measures to combat AIDSIn the light of the conclusions of the Council and the Ministers for Health meeting within the Council on 16 May 1989 (2) which:- requested the Commission to prepare and submit to the Council by the end of 1989 a programme on the prevention of AIDS in intravenous drug users,-requested the Commission to examine, within the framework of the internal market, the possibilities for harmonization of condoms and HIV self-testing kits,-instructed the ad hoc Working Party on AIDS, in close cooperation with, and with the participation of, the Commission, to develop the exchange of information on the results of the assessment of the national prevention measures including information campaigns, and on awareness measures for health personnel and finally to examine the possibilities for improving at Community level the HIV-related technical safety requirements for organs, tissues, semen and blood: (a) the Commission is requested, on the basis of the guidelines laid down by the Council in this resolution and in close cooperation with the Member States and with the possible assistance of experts appointed by each of them, to:- develop exchanges of information and experience in priority areas of the fight against AIDS, in particular those indicated in the Annex hereto, and the resultant coordination,-draw up and submit to the Council, at the earliest opportunity, proposals defining the details and content of an action plan integrating appropriate measures to prevent and control AIDS, including the coordination of the pilot projects carried out by the Member States and contributions to preparing Community projects on research and international cooperation; (b)the ad hoc Working Party on AIDS in instructed, in accordance with the conclusions previously adopted by the Council and the Ministers for Health, to continue its work, in particular on exchanges of information and experience, to examine the communications and proposals to be submitted ...
