Een eerste poging tot hervormen vond plaats met het opstellen van het verdrag tot vaststelling van een Grondwet voor Europa.

VERSCHILLEN MET HET VERDRAG TOT VASTSTELLING VAN EEN GRONDWET VOOR EUROPA
DIFFERENCES WITH THE TREATY ESTABLISHING A CONSTITUTION FOR EUROPE

De Commissie zal de haalbaarheid en de noodzaak van een kaderwet in verband met diensten van algemeen belang opnieuw onderzoeken op het ogenblik van de inwerkingtreding van het Verdrag tot vaststelling van een Grondwet voor Europa, en met name van de nieuwe rechtsgrondslag van artikel III-6. Dit artikel bepaalt: «Onverminderd de artikelen III-55, III-56 en III-136 en gezien de plaats die de diensten van algemeen economisch belang innemen als diensten waaraan eenieder in de Unie waarde hecht, alsook de rol die zij vervullen bij het bevorderen van sociale en territoriale samenhang van de Unie en de lidstaten, dragen de Unie en de lidstaten er overeenkomstig hun onderscheiden bevoegdheden en binnen het toepassingsgebied van de Grondwet zorg voor, dat deze diensten functioneren op basis van beginselen en onder de voorwaarden, met name economische en financiële, die hen in staat stellen hun taken te vervullen.
The Commission will re-examine the feasibility and necessity of a framework law on services of general interest when the Constitutional Treaty comes into force, in particular the new legal basis introduced by Article III-122 which states that: "Without prejudice to Articles III-55, III-56 and III-136, and given the place occupied by services of general economic interest as services to which all in the Union attribute value as well as their role in promoting social and territorial cohesion, the Union and the Member States, each within their respective powers and within the scope of application of the Constitution, shall take care that such services operate on the basis of principles and conditions, in particular economic and financial, which enable them to fulfil their missions.

(1) Artikel I-2 van het op 29 oktober 2004 ondertekende Verdrag tot vaststelling van een Grondwet voor Europa bepaalt dat een van de waarden waarop de Unie berust eerbied voor de menselijke waardigheid is; het Handvest van de grondrechten van de Europese Unie ("het Handvest"), dat in deel II van het Verdrag tot vaststelling van een Grondwet voor Europa is opgenomen, erkent in artikel 1 (artikel II-61 van het Verdrag) de onschendbaarheid van de menselijke waardigheid en bepaalt dat deze dient te worden geëerbiedigd en beschermd.
(1) Article I-2 of the Treaty establishing a Constitution for Europe, signed on 29 October 2004, provides that one of the values on which the European Union is founded is respect for human dignity; in the Charter of Fundamental Rights of the European Union ("the Charter"), incorporated in Part II of the Treaty establishing a Constitution for Europe, the inviolability of human dignity is recognised under Article 1 (Article II-61 of the Treaty), which provides that it must be respected and protected.

– gezien het Verdrag tot vaststelling van een Grondwet voor Europa (hierna de "Grondwet" genoemd),
– having regard to the Treaty establishing a Constitution for Europe (hereinafter 'the Constitution'),

– gezien het Ontwerp-Verdrag tot vaststelling van een Grondwet voor Europa dat door de Europese Conventie op 13 juni en 10 juli 2003 bij consensus is goedgekeurd, alsmede onder verwijzing naar zijn resoluties ter voorbereiding en vervolgens beoordeling van het werk van de Conventie,
– having regard to the draft Treaty establishing a Constitution for Europe adopted by consensus by the European Convention on 13 June and 10 July 2003, as well as its resolutions preparing and subsequently assessing the work of the Convention,

Tezelfdertijd juicht de Commissie de wijziging van het huidige artikel 16 van het EG-Verdrag toe, die door de Europese Conventie wordt voorgesteld in artikel III-6 van het ontwerp-verdrag tot vaststelling van een grondwet voor Europa.
At the same time, the Commission welcomes the amendment of the provisions of the current Article 16 EC Treaty as proposed by the European Convention in Article III-6 of the draft Constitutional Treaty.

1. is verheugd over de vooruitgang bij de Europese integratie en de democratische ontwikkeling, zoals belichaamd in de door de Conventie voorgestelde "Grondwet voor Europa" die via een passend Verdrag tot vaststelling van een Grondwet voor Europa moet worden vastgesteld, waarvan de tekst de politieke wil van de Europese burgers en de lidstaten plechtig en alomvattend tot uitdrukking brengt;
