Als gevolg van het bovenstaande kunnen nri’s in de lidstaten waar bij de inwerkingtreding van deze aanbeveling de maandelijkse huurprijzen voor volledig ontbundelde toegang tot het koperen aansluitnet, aangepast aan de hand van de gemiddelde (jaarlijkse) consumentenprijzenindex in de Unie, binnen het prijsbereik vallen, tot 31 december 2016 de kostenmethodologie blijven toepassen die zij gebruiken bij de inwerkingtreding van deze aanbeveling.
As a result of the above, in those Member States, where at the time of entry into force of this Recommendation, the monthly rental prices for the full unbundled copper local loop fall within the price band, as adjusted according to the Union average (annual) retail price index, NRAs may continue to apply until 31 December 2016 the costing methodology that they use at the time of entry into force of this Recommendation.

Behalve in gevallen die onder punt 40 vallen, moeten de nri’s in de lidstaten waar de maandelijkse huurprijzen voor volledig ontbundelde toegang tot het koperen aansluitnet bij de inwerkingtreding van deze aanbeveling buiten het prijsbereik vallen, de kosten en de daaruit resulterende toegangsprijzen zo spoedig mogelijk berekenen op basis van de aanbevolen kostenmethodologie en de overeenstemmende ontwerpmaatregel overeenkomstig de raadplegingsprocedure van artikel 7 van Richtlijn 2002/21/EG tijdig melden om te waarborgen dat de aanbevolen kostenmethodologie uiterlijk op 31 december 2016 volledig ten uitvoer is gelegd, daarbij rekening houdend met het feit dat er mogelijk geleidelijke prijsaanpassingen zullen nodig zijn, met name in lidstaten waar de toegangsprijzen momenteel niet kostengeoriënteerd zijn.
Save in cases covered by point 40, in those Member States, where, at the time of entry into force of this Recommendation, monthly rental prices for the full unbundled copper local loop fall outside the price band, NRAs should calculate costs and resulting access prices on the basis of the recommended costing methodology as soon as possible and notify the corresponding draft measure in accordance with the consultation procedure in Article 7 of Directive 2002/21/EC in due time, to ensure full implementation of the recommended costing methodology by 31 December 2016, bearing in mind the potential need for gradual price adjustments, in particular in those Member States where access prices are currently not cost oriented.
