Verordening (EG) nr. 2073/2004 van de Raad van 16 november 2004 betreffende de administratieve samenwerking op het gebied van de accijnzen voorziet in een gemeenschappelijke regeling in het kader waarvan de lidstaten elkaar bijstand verlenen en samenwerken met de Commissie met het oog op de juiste toepassing van de accijnswetgeving en de bestrijding van de ontduiking van accijnsrechten en de daaruit voortvloeiende verstoringen van de interne markt.
Council Regulation (EC) No 2073/2004 of 16 November 2004 on administrative cooperation in the field of excise duties provides for a common system whereby, in order to ensure the correct application of legislation on excise duties and to combat the evasion of excise duties and the ensuing distortions in the internal market, Member States assist each other and cooperate with the Commission.

Voor de bestrijding van ontduiking van accijnsrechten en de daaruit voortvloeiende verstoringen van de interne markt worden in deze verordening de voorwaarden vastgesteld voor samenwerking en uitwisseling van inlichtingen tussen EU-landen bij de toepassing van accijnswetgeving en de juiste naleving ervan onder EU-regels.
To combat the evasion of excise duties and reduce distortions in the internal market, the regulation lays down the conditions for cooperation and information exchange between EU countries in applying excise legislation and for proper compliance under EU rules.

Bij brief van 13 oktober 2001 heeft de Commissie Frankrijk in kennis gesteld van haar besluit tot inleiding van de procedure van artikel 88, lid 2, EG ten aanzien van de vrijstelling van accijnsrechten op mineralen oliën die als brandstof worden gebruikt voor de productie van aluminiumoxide in de Gardanne (2) Na afloop van deze procedure heeft de Commissie op 7 december 2005 de bestreden beschikking (3) vastgesteld, waarin zij tot de conclusie komt dat de door Frankrijk, Ierland en Italië verleende vrijstelling van accijnsrechten voor minerale oliën die worden gebruikt als brandstof voor de productie van aluminiumoxide in respectievelijk de Gardanne, Shannon en Sardinië, staatssteun vormt in de zin van artikel 87, lid 1, EG die gedeeltelijk onverenigbaar is met de gemeenschappelijke markt, en aldus de betrokken lidstaten gelast deze steun terug te vorderen.
In a letter of 30 October 2001 the Commission notified France of its decision to initiate proceedings under Article 88(2) of the EC Treaty relating to the exemption from excise rights on mineral oils used as fuel for alumina production in the Gardanne region (2). On 7 December 2005, in consequence of this procedure, the Commission adopted the disputed decision (3) finding that exemptions from excise duty on mineral oils used as fuel for alumina production in the Gardanne region, the Shannon region and Sardinia, implemented by France, Ireland and Italy respectively, constituted State aid within the meaning of Article 87(1) EC that is in part incompatible with the common market, and thus ordered the Member States concerned to recover all such aid.
