EU law on Birds (Directive 2009/147/EC) and Habitats (Council Directive 92/43/EEC) is the cornerstone of Europe's nature conservation policy and establish the EU wide Natura 2000 ecological network of protected areas, safeguarded against potentially damaging developments.

To achieve these objectives, the Union – recognising the fundamental importance of biodiversity conservation in the outermost regions – should affirm the voluntary scheme for promoting conservation and sustainable use of BEST in those outermost regions referred to in Article 349 TFEU to which Union environmental protection legislation (Directives 92/43/EC and 2009/147/EC) does not apply, thus drawing on the experience acquired through Union nature conservation policy, in particular Natura 2000.

74. acht het van essentieel belang dat in de EU gevestigde ondernemingen de EU-milieunormen naleven bij hun werkzaamheden en/of investeringen in de kandidaatlanden; verzoekt de Commissie met UNICE te onderhandelen over een dergelijke "milieugedragscode”; wijst erop dat alle EU pretoetredingssteun compatibel dient te zijn met de EU-aanpak van integratie van milieuoverwegingen in andere beleidssectoren en verzoekt de Commissie milieueffectrapportages te verrichten en te publiceren van alle door de EU gefinancierde pretoetredingsprojecten en -plannen met inbegrip van leningen van de EIB, voordat deze fondsen beschikbaar worden gesteld; dringt erop aan dat de EIB als zij dergelijke leningen verstrekt aan kandidaatlanden in Midden- en Oost-Europa de openbaarheid van haar handelingen en haar algemene beleid inzake voorlichting van de publieke opinie aanzienlijk verbetert; verzoekt de terzake bevoegde autoriteiten te onderzoeken op welke wijze meer geld beschikbaar kan worden gesteld voor directe steun aan natuurbehoud, zowel vóór als na de toetreding, bijvoorbeeld door verruiming van de criteria op grond waarvan ISPA-middelen kunnen worden toegewezen aan milieuprojecten met dien verstande dat deze criteria tevens activiteiten inzake natuurbehoud omvatten, met name de aanwijzing van geschikte terreinen voor Natura 2000 en het beheer daarna van dergelijke terreinen;
74. Considers it essential that companies based in the EU comply with EU environmental standards when operating and/or investing in the candidate countries, asks the Commission to negotiate such an 'environmental code of conduct' with UNICE; emphasises that all EU pre-accession aid should be compatible with the EU approach of integrating environmental considerations into other policies and to this end requests the Commission to make and publish environmental impact assessments of all EU-financed pre-accession projects and plans, including loans from the EIB, prior to putting these funds into operation, and demands that in making such loans within the candidate countries of Central and Eastern Europe, the EIB greatly improve the transparency of its practices and general policies on providing information to the public; calls on the competent authorities to examine ways in which more funding can be made available for the direct support of nature conservation both before and after accession, for example by broadening the criteria under which ISPA funds can be allocated to environmental projects so that these criteria include nature conservation activities, particularly the identification of suitable sites for Natura 2000 and the subsequent management of such sites;
