3. In afwijking van artikel 211, lid 1, van Verordening (EU) nr. 1308/2013 en mits de Commissie daarvoor, zonder toepassing van de in artikel 37, lid 2 of lid 3, van deze verordening bedoelde procedure, toestemming verleent, kunnen de lidstaten nationale betalingen toekennen om landbouwers die hun landbouwproducten niet als biologisch in de handel kunnen brengen omdat deze verontreinigd zijn met niet-toegelaten producten of stoffen, te vergoeden voor het daardoor veroorzaakte verlies, op voorwaarde dat deze landbouwers alle gepaste maatregelen hebben genomen om het risico van een dergelijke verontreiniging te voorkomen. Daarnaast kunnen de lidstaten een beroep doen op de instrumenten van het gemeenschappelijk landbouwbeleid om dergelijke verliezen geheel of gedeeltelijk te vergoeden.
3. By way of derogation from Article 211(1) of Regulation (EU) No 1308/2013, and subject to an authorization by the Commission adopted without applying the procedure referred to in Article 37(2) or (3) of this Regulation, Member States may grant national payments to compensate farmers for the losses they have incurred due to the contamination of their agricultural products by non-authorised products or substances which prevents them from marketing those products as organic provided that the farmers have taken all appropriate measures to prevent the risk of such contamination. Member States may also use the instruments of the Common Agricultural Policy to cover totally or partially such losses.

This Directive should contribute to the fulfilment of the obligations and important commitments of the Community and the Member States under several relevant international agreements relating to the protection of the marine environment from pollution: the Convention on the Protection of the Marine Environment of the Baltic Sea Area, approved by Council Decision 94/157/EC , the Convention for the Protection of the Marine Environment of the North-East Atlantic, approved by Council Decision 98/249/EC , including its new Annex V on the Protection and Conservation of the Ecosystems and Biological Diversity of the Maritime Area and the corresponding Appendix 3, approved by Council Decision 2000/340/EC , the Convention for the Protection of the Marine Environment and the Coastal Region of the Mediterranean, approved by Council Decision 77/585/EEC , and its amendments from 1995, approved by Council Decision 1999/802/EC , as well as its Protocol for the Protection of the Mediterranean Sea Against Pollution from Land-Based Sources, approved by Council Decision 83/101/EEC , and its amendments from 1996, approved by Council Decision 1999/801/EC .
