All end-users with numbers from a national telephone numbering plan who so request shall have the right to retain their number(s) independently of the provider of electronic communications to the public providing the service in accordance with Part C of Annex I to Directive 2002/22/EC, provided the provider is an electronic communications provider in the Member State to which the national numbering plan relates or is a European electronic communications provider which has notified to the competent regulatory authority of the home Member State the fact that it provides or intends to provide such services in the Member State to which the national numbering plan relates.

(14) Measures should be taken to prevent unauthorised access to communications in order to protect the confidentiality of communications, including both the contents and any data related to such communications, by means of public communications networks and publicly available electronic communications services.

D. overwegende dat het interceptiesysteem met name gebaseerd is op het wereldwijd afluisteren van satellietcommunicatie; dat echter communicatie in gebieden met een dicht communicatieverkeer slechts in zeer beperkte mate via satellieten wordt afgewikkeld; dat bijgevolg het leeuwendeel van de communicatie niet door middel van grondstations kan worden afgeluisterd, maar alleen door het aftappen van kabels en het onderscheppen van radioverkeer, hetgeen - zoals uit onderzoeken in het kader van dit verslag blijkt - slechts in beperkte mate mogelijk is; dat de hoeveelheid van het voor de uiteindelijke analyse van de onderschepte communicatie benodigde personeel verdere beperkingen met zich meebrengt, dat als gevolg daarvan de UKUSA-landen slechts toegang hebben tot een zeer beperkt deel van de kabel- en radiocommunicatie en zelfs een nog beperkter deel van de communicatie kunnen analyseren; verder overwegende dat, hoe groot de mogelijkheden en capaciteiten voor de interceptie van communicaties ook zijn, het zeer hoge aantal daarvan het in de praktijk onmogelijk maakt om deze alle uitputtend en gedetailleerd te controleren,
D. whereas the surveillance system depends, in particular, upon worldwide interception of satellite communications, although in areas characterised by a high volume of communications only a very small proportion of those communications are transmitted by satellite; whereas this means that the majority of communications cannot be intercepted by earth stations, but only by tapping cables and intercepting radio signals, something which - as the investigations carried out in connection with the report have shown - is possible only to a limited extent; whereas the numbers of personnel required for the final analysis of intercepted communications imposes further restrictions; whereas, therefore, the UKUSA states have access to only a very limited proportion of cable and radio communications and can analyse an even more limited proportion of those communications, and whereas, further, however extensive the resources and capabilities for the interception of communications may be, the extremely high volume of traffic makes exhaustive, detailed monitoring of all communications impossible in practice,

In de National Security Council Intelligence Directive 9 (NSCID 9) van 10 maart 1950 wordt voor COMINT-doeleinden het begrip buitenlandse communicatie omschreven; volgens dat document is buitenlandse communicatie elke officiële communicatie in de ruimste zin (niet alleen militair), alsmede alle andere communicatie die informatie met militaire, politieke, wetenschappelijke of economische waarde kan bevatten.
In National Security Council Intelligence Directive 9 (NSCID 9) of 10 March 1950 the term ‘foreign communications’ is defined for COMINT purposes: it comprises any government communications in the widest sense (not only military) and all other communications which might contain information of military, political, scientific or economic value.

(30) De toezending van ongevraagde commerciële communicatie via elektronische post kan voor consumenten en verleners van diensten van de informatiemaatschappij niet gewenst zijn en kan de soepele functionering van interactieve netwerken ontregelen. Het probleem van de instemming van ontvangers van sommige soorten van ongevraagde commerciële communicatie wordt niet behandeld in deze richtlijn, maar is reeds behandeld in Richtlijn 97/7/EG en Richtlijn 97/66/EG. In lidstaten die ongevraagde commerciële communicatie via elektronische post toestaan, moeten initiatieven van de bedrijfstak om goede filters aan te brengen, worden aangemoedigd en vergemakkelijkt. Ongevraagde commerciële communicatie moet in ieder geval duidelijk als zodanig kunnen worden geïdentificeerd om de doorzichtigheid te verbeteren en de functionering van dergelijke initiatieven van de bedrijfstak te vergemakkelijken.
(30) The sending of unsolicited commercial communications by electronic mail may be undesirable for consumers and information society service providers and may disrupt the smooth functioning of interactive networks; the question of consent by recipient of certain forms of unsolicited commercial communications is not addressed by this Directive, but has already been addressed, in particular, by Directive 97/7/EC and by Directive 97/66/EC; in Member States which authorise unsolicited commercial communications by electronic mail, the setting up of appropriate industry filtering initiatives should be encouraged and facilitated; in addition it is necessary that in any event unsolicited commercial communities are clearly identifiable as such in order to improve transparency and to facilitate the functioning of such industry initiatives; unsolicited commercial communications by electronic mail should not result in additional communication costs for the recipient.
