IN-CONTEXT TRANSLATIONS

C. overwegende dat in de 20 jaren na de ondertekening van het vredesakkoord van Dayton de grondwet van BiH "volledig teniet is gedaan" door leden de internationale gemeenschap en een aantal lokale actoren, onder meer de hoge vertegenwoordiger in BiH , het constitutioneel gerechtshof van BiH en de VN-Veiligheidsraad;
C. whereas in the 20 years since the signing of the Dayton Peace Agreement the BiH Constitution has been ‘massively devastated’ by members of the international community and a number of local actors, including the High Representative for BiH, the BiH Constitutional Court and the UN Security Council;

D. overwegende dat zowel lid 5 van artikel 3, en letter a) van lid 3 van artikel 3 van de grondwet van BiH door het constitutioneel gerechtshof van BiH en het Bureau van de hoge vertegenwoordiger (OHR) gebruikt worden om onrechtmatige schendingen van het vredesakkoord van Dayton te legitimeren op quasi-wettelijke gronden;
D. whereas both Articles 3.5 and 3.3(a) of the BiH Constitution are being used by the BiH Constitutional Court and the Office of the High Representative (OHR) to legitimise unauthorised violations of the Dayton Peace Agreement on quasi-legal grounds;

G. overwegende dat Oekraïne - na het besluit van het Constitutioneel Gerechtshof om de in 2007 ingevoerde amendementen op de grondwet onwettig te verklaren - een algemene constitutionele hervorming moet doorvoeren om een functionerend en efficiënt systeem van wederzijdse controle in te voeren, teneinde duidelijk vast te stellen wat de verdeling van bevoegdheden is tussen president, ministerraad en Verkhovna Rada (het parlement),
G. whereas – following the decision by the Constitutional Court to declare the 2007 amendments to the Constitution illegal - Ukraine must proceed to an overall constitutional reform in order to establish a viable and efficient system of checks and balances to define a clear distribution of competences between the President, the Cabinet of Ministers and the Verkhovna Rada,

Zoals bovendien uit talrijke arresten van het Italiaans constitutioneel gerechtshof blijkt functioneert de Italiaanse openbare omroep al jarenlang op illegale wijze, en daarvoor heeft de wetgever nog steeds geen oplossing gevonden. De tot nu toe uitgevaardigde wetten, waarmee het de facto-gebruik van frequenties werd bekrachtigd - de grootste particuliere groep gebruikt installaties zonder vergunning en concessies, wat geheel in strijd is met overwegingen inzake de versterking van het pluralisme - zijn allen inconstitutioneel verklaard. In addition, as demonstrated by numerous judgments by the Italian Constitutional Court, the Italian broadcasting service has for years been operating in unlawful circumstances, which the legislators have not yet remedied; indeed, the laws passed so far, which have ratified the de facto occupation of frequencies – that is to say, the operation of installations by the largest private group without concessions or authorisations, totally at variance with any concern for greater pluralism – have gradually been declared unconstitutional, and the latest law reforming the audiovisual sector has been referred back to Parliament by the President of the Republic because it did not comply with the principles laid down by the Constitutional Court.

17. is van mening dat artikel L, sub c) van het Verdrag betreffende de Europese Unie, zoals dit door het Verdrag van Amsterdam moet worden ingevoerd, als opdracht aan het Hof van Justitie van de Europese Gemeenschappen moet worden beschouwd om een hoogstaande en volledige bescherming van de grondrechten op het werkterrein van de Europese Gemeenschap, en, voorzover het Hof van Justitie van de Europese Gemeenschappen daartoe de bevoegdheid bezit, op het werkterrein van de Europese Unie, te waarborgen en te ontwikkelen, met dien verstande dat de bescherming van de rechten van de mens door het Hof van Justitie ten minste van hetzelfde niveau moet zijn als die van een willekeurig nationaal constitutioneel gerechtshof;
17. Considers that Article L(c) of the EU Treaty, as it is to be inserted by the Treaty of Amsterdam, should be regarded as giving the European Court of Justice a mission to ensure and develop comprehensive protection of fundamental rights, of a high standard, in respect of the sphere of activity of the European Community such that the standard of protection of human rights by the Court of Justice of the European Communities is at least as high as under any national constitutional jurisdiction, in so far as the ECJ has jurisdiction, in respect of the sphere of activity of the European Union;

Volledig eerbiedigen van het Constitutioneel Handvest en waarborgen van het effectieve functioneren van de Statenunie (met name wat betreft de bevoegdheden van het Gerechtshof van Servië en Montenegro, het functioneren van het Parlement van de Statenunie en de goedkeuring van wetgeving inzake duurzame financiering van de Statenunie); een constructieve aanpak moet worden gehanteerd bij de verdeling van bevoegdheden tussen de Statenunie en de Republieken.
