(33) In order to facilitate the procedure, Ö Regulation (EC) No 810/2009 provides for Õ several forms of cooperation should be envisaged, such as limited representation, co-location, common application centres, recourse to honorary consuls and cooperation with external service providers, taking into account in particular data protection requirements set out in Directive 95/46/EC Ö among Member States aimed at, on the one hand, allowing Member States to pool resources and on the other, at enhancing the consular coverage for the benefit of applicants Õ. Member States should, in accordance with the conditions laid down in this Regulation, determine the type of organisational structure which they will use in each third country. ð Flexible rules should be established to allow Member States to optimise the sharing of resources and to increase consular coverage.

14. is van mening dat gemeenschappelijke minimumnormen het recht van eenieder moeten omvatten om onverwijld zijn consulaire vertegenwoordiger of een daartoe geëigende organisatie te waarschuwen en dat dit betekent dat de lidstaten moeten zorgen voor consulaire bijstand (al bestaan er reeds internationale, Europese en nationale instrumenten die alle lidstaten hiertoe verplichten), waarbij de consulaire vertegenwoordiger waakt over de rechten van zijn landgenoten die in het buitenland verdacht worden van een misdrijf of worden vastgehouden op verdenking daarvan, en dat de politiële, justitiële dan wel penitentiaire autoriteiten de plicht hebben om buitenlandse gedetineerden bij hun inhechtenisneming onmiddellijk te wijzen op de mogelijkheid om de consul van hun land te verwittigen van de omstandigheden van hun detentie en hem te verzoeken om de gedetineerde op te zoeken of contact met hem en met hun familie op te nemen; ook moeten er sancties worden toegepast in geval van overtreding;

Considers that a common minimum standard should include the right of a person to contact their consular representative or an appropriate organisation without delay and the consequent requirement for the Member States to provide consular assistance (even where all the Member States are already bound by existing national, EU and international instruments) and to make their consular representation responsible for upholding the rights of their nationals abroad when they are charged with, or arrested for, allegedly having committed an offence, and should also lay down a requirement for the police, judicial or prison authorities (as appropriate) to inform foreigners who have been arrested (and to do so immediately upon their arrest) that they may notify their country's consul regarding the circumstances of their arrest, ask the consul to visit them or establish contact with them and with their family; penalties should also be laid down, to be imposed in the event of non-compliance;
