– gezien het Europees Octrooiverdrag (EOV) van 5 oktober 1973, met name artikel 53, onder b),
– having regard to the European Patent Convention (EPC) of 5 October 1973, in particular Article 53(b) thereof,

1. Gezien het feit dat aanvragen van Europese octrooien in elke taal overeenkomstig artikel 14, lid 2, EOV mogen worden ingediend, belasten de deelnemende lidstaten overeenkomstig artikel 9 van Verordening (EU) nr. [.../2012] van het Europees Parlement en de Raad tot het aangaan van nauwere samenwerking op het gebied van de instelling van eenheidsoctrooibescherming en krachtens artikel 143 EOV het Europees Octrooibureau met het beheer van een regeling voor de compensatie van alle vertaalkosten tot een bepaald plafond, die gefinancierd wordt door de in artikel 10 van die verordening bedoelde taksen, van aanvragers die bij het Europees Octrooibureau octrooiaanvragen indienen in een van de officiële talen van de Unie die geen officiële taal van het Europees Octrooibureau is.
1. Given the fact that European patent applications may be filed in any language under Article 14(2) of the EPC, in accordance with Article 9 of Regulation (EU) No [.../2012] of the European Parliament and of the Council implementing enhanced cooperation in the area of the creation of unitary patent protection , the participating Member States, shall give, within the meaning of Article 143 of the EPC, the European Patent Office the task of administering a compensation scheme of reimbursing all translation costs up to a ceiling, from the fees referred to in Article 10 of that Regulation, for applicants filing patent applications at the European Patent Office in one of the official languages of the Union that is not an official language of the European Patent Office.

[2] Om de aan geldigverklaringvereisten verbonden kosten te verminderen, hebben de bij het EOV aangesloten staten in 2000 de zogeheten Overeenkomst van Londen (Overeenkomst over de toepassing van artikel 65 EOV, PB EOB van 2001, blz. 550) aangenomen, die thans in elf EU‑lidstaten geldt en verminderde vertaalvereisten inhoudt.
[2] In order to reduce the costs caused by validation requirements, in 2000 the EPC Contracting States adopted the so-called "London Agreement" (Agreement on the application of Article 65 EPC, OJ EPO 2001, 550) which is currently in force in eleven EU Member States and results in reduced translation requirements.

Patent applicants should remain free to obtain either a national patent, a European patent with unitary effect, a European patent taking effect in one or more of the Contracting States to the EPC or a European patent with unitary effect validated in addition in one or more other Contracting States to the EPC which are not among the participating Member States.

In de Europese Unie (EU) kan momenteel octrooibescherming worden verkregen hetzij via de nationale octrooibureaus van de lidstaten die nationale octrooien verlenen, hetzij via het Europees Octrooibureau (EOB) in het kader van het Europees Octrooiverdrag (EOV)[1].
In the European Union (EU), patent protection currently can be obtained either through the national patent offices of the Member States, which grant national patents, or through the European Patent Office (EPO) in the framework of the European Patent Convention (EPC)[1].

Ook al waarborgt het EOV, evenals het Amerikaanse en Japanse octrooibureau, op grote schaal octrooibescherming voor op computerprogrammatuur gebaseerde uitvindingen, dan toch zou computerprogrammatuur uit de bepalingen van artikel 52, lid 2, van het EOV moeten worden geschrapt en dientengevolge een octrooieerbare uitvinding moeten worden.
Although the EPC, like the United States and Japanese Patent Offices, provides a large measure of patent protection for software-related inventions, computer programmes should be deleted from the provisions of Article 52(2) of the European Patent Convention and thus become patentable inventions.
