TRADUCTIONS EN CONTEXTE

K. overwegende dat de voormalige speciale vertegenwoordiger van de secretaris-generaal van de VN John Ruggie de EU-lidstaten, in het kader van de door het toen Zweedse voorzitterschap bijeengeroepen conferentie over MVO, heeft opgeroepen tot verduidelijking en ondersteuning van de kwestie van extraterritoriale rechtsmacht voor schendingen door bedrijven in kwetsbare derde landen; overwegende dat deze oproep vervolgens in conclusies van de Europese Raad werd ondersteund, maar dat tot op heden geen desbetreffende maatregelen zijn genomen;
K. whereas the UN Secretary-General’s former Special Representative for Business and Human Rights, John Ruggie, appealed to the EU Member States, as part of the CSR Conference convened by the then Swedish Presidency, to clarify and support the issue of extraterritorial jurisdiction for violations by companies in fragile third countries; whereas his appeal was subsequently endorsed in European Council conclusions, but no action has been taken in response to it to date;

Het is tevens tijd om de gevoelige kwestie van extraterritoriale rechtsmacht aan te pakken, met betrekking tot misbruik op de arbeidsmarkt of bredere schendingen van de mensenrechten door Europese bedrijven in derde landen waar de toegang tot de rechter beperkt is.
It is also now time to tackle the sensitive issue of extraterritorial jurisdiction, concerning abuses of labour or wider human rights by European enterprises, which take place in third countries where access to justice is restricted.

8. verzoekt de Commissie en met name DG Justitie voorstellen in te dienen betreffende de extraterritoriale rechtsmacht voor EU-rechtbanken voor gevallen van schending van de mensenrechten door in de EU gevestigde bedrijven of hun dochterondernemingen, onderaannemers of handelspartners;
8. Calls on the Commission, in particular DG Justice, to present proposals regarding the extraterritorial jurisdiction of EU courts in cases of human rights violations on the part of EU companies or their subsidiaries, subcontractors or trading partners;

er moet aandacht worden besteed aan de noodzaak van extraterritoriale rechtsmacht voor dit soort delicten, ten aanzien van zowel EU-burgers als ingezetenen in de EU;
due attention should be paid to the need for extraterritorial jurisdiction for trafficking-related offences, with regard to both EU nationals and residents;

Wat de extraterritoriale rechtsmacht betreft, bestaan er in de meerderheid van de lidstaten reeds regels, of komen deze er binnenkort, die in uiteenlopende mate aansluiten op de beginselen van actieve en passieve personaliteit, zoals voorgeschreven in artikel 6, lid 1, onder b) en c).
As regards extra-territorial jurisdiction, a majority of Member States have or will have rules which to different extents cover the principles of active and passive personality, as required in Article 6(1)(b) and (c).

Wat de extraterritoriale rechtsmacht betreft, bestaan in de meerderheid van de lidstaten regels die - ten minste gedeeltelijk – de in artikel 9, lid 1 onder c) en e), vastgelegde beginselen van actieve en passieve personaliteit dekken of zullen die regels er komen.
As regards extra-territorial jurisdiction, a majority of Member States have or will have rules which cover- at least partially – the principles of active and passive personality laid down in Article 9(1)(c) and (e).
