(4) Artikel 2, lid 1, van Verordening (EG) nr. 1164/94 van de Raad van 16 mei 1994 tot oprichting van een Cohesiefonds moet samen met deel 15 van bijlage II bij de Toetredingsakte van 2003, "Regionaal beleid en coördinatie van structurele middelen", worden gelezen.Artikel 2, lid 1, bepaalt dat uit het Fonds een financiële bijdrage wordt verleend voor projecten die bijdragen tot de in het Verdrag betreffende de Europese Unie neergelegde doelstellingen op het gebied van het milieu en van Trans-Europese netwerken in de sfeer van de vervoersinfrastructuur in lidstaten waarvan het bruto nationaal product (BNP) per hoofd van de bevolking, gemeten in koopkrachtpariteiten, minder dan 90% van het gemiddelde voor de Gemeenschap bedraagt en die over een programma beschikken waardoor aan de voorwaarden inzake economische convergentie bedoeld in artikel 104 C van het Verdrag wordt voldaan.
(4) Article 2(1) of Council Regulation (EC) No 1164/94 of 16 May 1994 establishing a Cohesion Fund , – must be read in conjunction with Part 15 of Annex II of the 2003 Act of Accession, entitled “Regional Policy and coordination of structural instruments”.That Article 2(1) states that the Fund shall provide financial contributions to projects, which contribute to achieving the objectives laid down in the Treaty on European Union, in the fields of the environment and trans-European transport infrastructure networks in Member States with a per capita gross national product (GNP), measured in purchasing power parities, of less than 90 % of the Community average which have a programme leading to the fulfilment of the conditions of economic convergence referred to in Article 104c of the Treaty.

Bij artikel 130 D van het Verdrag betreffende de Europese Unie (EU-Verdrag) is een Cohesiefonds ingesteld dat "een financiële bijdrage (levert) aan projecten op het gebied van milieu en trans-Europese netwerken in de sfeer van de vervoersinfrastructuur" voor lidstaten met een BNP per hoofd van de bevolking van minder dan 90% van het EU-gemiddelde.

Werkingssfeer 1. Uit het Fonds wordt een financiële bijdrage verleend voor projecten die bijdragen tot de in het Verdrag betreffende de Europese Unie neergelegde doelstellingen op het gebied van het milieu en van transeuropese netwerken in de sfeer van de vervoeringsinfrastructuur in Lid-Staten waarvan het bruto nationaal produkt (BNP) per hoofd van de bevolking minder dan 90 % van het gemiddelde voor de Gemeenschap, bepaald op basis van koopkrachtpariteit, bedraagt en die over een programma beschikken waardoor aan de voorwaarden inzake economische convergentie bedoeld in artikel 104 C van het Verdrag wordt voldaan.
