De Commissie heeft de Franse autoriteiten, naar aanleiding van een klacht, per fax van 28 november 2011 verzocht om haar alle informatie te doen toekomen die noodzakelijk is voor een onderzoek, in het licht van de artikelen 107 en 108 van het Verdrag betreffende de werking van de Europese Unie (VWEU), naar de heffing die is ingesteld bij artikel 25 van wet nr. 2005-1720 van 30 december 2005 ten voordele van de nationale instantie voor de producten van de landbouw en de zee (FranceAgriMer) (hierna „de heffing” genoemd).
Following a complaint, the Commission asked the French authorities by fax of 28 November 2011 to provide it with any information necessary for an investigation, under Articles 107 and 108 of the Treaty on the Functioning of the European Union (TFEU), into the tax established by Article 25 of Law No 2005-1720 of 30 December 2005 for the benefit of the national organisation of agriculture and fisheries products (FranceAgriMer) (‘the tax’).

Het doel is tweeledig: enerzijds wordt beoogd de Europese industrie (bijv. op terreinen als chemie, gezondheid, mijnbouw, energie, pulp en papier, vezelproducten en hout, textiel, zetmeel, en voedingsmiddelen) in staat te stellen nieuwe producten en processen te ontwikkelen om in industriële en maatschappelijke behoeften te voorzien, met bij voorkeur milieuvriendelijke en duurzame productiemethoden, en daarnaast concurrerende en verbeterde alternatieven op biotechnologische basis te ontwikkelen om bestaande producten en processen te vervangen; anderzijds is het de bedoeling het potentieel van de biotechnologie te benutten om vervuilende stoffen op te sporen, te bewaken, te voorkomen en te verwijderen.
The objective is twofold: on the one hand, enabling the European industry (e.g. chemical, health, mining, energy, pulp and paper, fibre-based products and wood, textile, starch, and food processing industries) to develop new products and processes meeting industrial and societal demands using preferably environmentally friendly and sustainable production methods and competitive and enhanced biotechnology-based alternatives to replace established ones; on the other hand, harnessing the potential of biotechnology for detecting, monitoring, preventing and removing pollution.
