1. Het Internationaal Strafhof (hierna „het ISH” genoemd) is voor de voorkoming en beteugeling van de ernstige misdrijven waarover het rechtsmacht heeft een essentiële stap ter bevordering van de eerbiediging van het internationaal humanitair recht en de mensenrechten, waardoor wordt bijgedragen tot vrijheid, veiligheid, rechtvaardigheid en de rechtsstaat en tot de handhaving van de vrede, de voorkoming van conflicten en de versterking van de internationale veiligheid, overeenkomstig de doelstellingen en beginselen van het Handvest van de Verenigde Naties.
1. The International Criminal Court (hereinafter the ‘ICC’), for the purpose of preventing and curbing the commission of the serious crimes falling within its jurisdiction, is an essential means of promoting respect for international humanitarian law and human rights, thus contributing to freedom, security, justice and the rule of law as well as contributing to the preservation of peace, the prevention of conflicts and the strengthening of international security, in accordance with the purposes and principles of the Charter of the United Nations.

51. verzoekt alle partijen bij het Internationaal Strafhof, de Europese Unie en het Internationaal Strafhof zelf, met inbegrip van het parket van de aanklager, met klem alles in het werk te stellen om de plegers van seksuele misdrijven tegen de menselijkheid te vervolgen en te straffen, te weten de specifieke categorie van misdrijven tegen de menselijkheid die onder de materiële bevoegdheid van het Internationaal Strafhof vallen (artikel 7 van het Statuut van Rome) waarbij het gaat om verkrachting, seksuele slavernij, gedwongen prostitutie, gedwongen zwangerschap, gedwongen sterilisatie en enige andere vorm van seksueel geweld van vergelijkbare ernst, alsmede om feiten in verband met vervolging op grond van geslacht; constateert dat deze seksuele misdrijven bijzonder verwerpelijk zijn en dat zij tegelijkertijd en op grote schaal zowel misdrijven tegen de menselijkheid als oorlogsmisdrijven (artikel 8 van het Statuut van Rome) kunnen zijn, en dat zij gericht zijn tegen de zwakste bevolkingsgroepen, vrouwen, kinderen en burgers in landen die reeds door conflictsituaties en/of voedseltekorten, ja zelfs hongersnood verzwakt zijn;
51. Urges all the States Parties to the ICC, the EU and the ICC itself, including the Office of the Prosecutor, to make every effort to prosecute and punish the perpetrators of sex crimes against humanity, which are a specific category of the crimes against humanity falling within the jurisdiction of the ICC (Article 7 of the Rome Statute) and include rape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilisation and any other form of sexual violence of comparable gravity, along with persecution on gender grounds; notes that such sex crimes are particularly despicable insofar as they are often perpetrated on a large scale and constitute war crimes as well as crimes against humanity (Article 8 of the Rome Statute) targeting the most vulnerable groups – women, children and civilians – in countries already weakened by conflicts and/or food shortages or famine;

1. moedigt de Europese Unie, met inbegrip van de EDEO, en de lidstaten van de Europese Unie ten stelligste aan om systematisch de diplomatieke instrumenten aan te wenden waarover zij beschikken om het Internationaal Strafhof te steunen en de derde landen, met name de ontwikkelingslanden, die dit nog niet hebben gedaan te wijzen op de noodzaak om het Internationaal Strafhof te steunen of de akte van oprichting te ondertekenen of te ratificeren door in de akkoorden met derde landen bindende clausules op te nemen die hen ertoe verplichten met het Internationaal Strafhof samen te werken of door restrictieve maatregelen op te leggen aan de personen die voor het Internationaal Strafhof zijn gedaagd; constateert dat de politieke dialogen en de mensenrechtendialogen die de Europese Unie met derde landen voert, alsook de topbijeenkomsten met die landen, met name met de ontwikkelingslanden waartoe ook de ACS-landen behoren, tot de passende structuren behoren om dit te doen;

Strongly encourages the European Union, including the EEAS, and the diplomatic services of the EU Member States systematically to use the tools of diplomacy available to them in order to promote the ICC and remind third countries – in particular developing countries – of the need for them to support it and to sign or ratify its constituent act if they have not yet done so, and to include in agreements with third countries binding clauses that require them to cooperate with the ICC, or, indeed to impose restrictions on persons against whom proceedings have been initiated in the ICC; notes that suitable structures for this purpose include the EU’s political and human rights dialogues with third countries – in particular developing countries and, among them, the ACP countries – and summits with those countries;

Het actieplan waartoe, onder andere, is opgeroepen in een resolutie betreffende de inwerkingtreding van het statuut van het Internationaal Strafhof die het Europees Parlement op 28 februari 2002 heeft goedgekeurd als follow-up van Gemeenschappelijk Standpunt 2001/443/GBVB van de Raad van 11 juni 2001 betreffende het Internationaal Strafhof , is op 4 februari 2004 aangenomen en moet indien nodig worden aangepast.
The Action Plan which was, inter alia, called for by a Resolution on entry into force of the Statute of the International Criminal Court approved by the European Parliament on 28 February 2002 to follow up Council Common Position 2001/443/CFSP of 11 June 2001 on the International Criminal Court was adopted on 4 February 2004 and should be adapted as appropriate.

52. Reiterates its strong support for the International Criminal Court and its primary objective of fighting impunity for genocide, war crimes and crimes against humanity; welcomes the fact that the ratifications of the Rome Statute by Bangladesh, the Seychelles, Saint Lucia and Moldova in March, August and October 2010 brought the total number of States Parties to 114; stresses that the Rome Statute of the ICC was ratified by all the EU Member States as an essential component of the democratic principles and values of the Union and therefore calls upon the Member States to comply fully with the Statute as part of the EU acquis; underlines the importance of the principle of universality, and calls on the EEAS, the EU Member States and the Commission to continue their vigorous efforts to promote universal ratification of the Rome Statute and the agreement on Privileges and Immunities of the International Criminal Court and national implementing legislation, and to review the Council Common Position 2003/444/CFSP of 16 June 2003 on the International Criminal Court and the 2004 Action Plan to follow up on the Common Position; requests that such efforts be extended to the Agreement on the Privileges and Immunities of the ICC (APIC), an important operational tool for the Court; further calls on EU Member States to revise and update the Common Position and Action Plan on the ICC in order to reinforce effective assistance by the EU of the ICC in light of current developments, challenges and needs of the Court, as the warrants for arrest and trials at the ICC continue to increase in number, as well as to start discussions on the possible adoption of EU guidelines on international justice/ ICC;

30. verzoekt de Raad en de Commissie verder te gaan met hun krachtige inspanningen voor het bevorderen van universele ratificatie van het Statuut van Rome en vaststelling van de vereiste nationale uitvoeringswetgeving, conform Gemeenschappelijk Standpunt 2003/444/GBVB van de Raad van 16 juni 2003 betreffende het Internationaal Strafhof en het Actieplan; wijst erop dat niet alle voorzitterschappen van de Raad dit gemeenschappelijke doel even krachtdadig nastreven; verzoekt alle voorzitterschappen om tijdens alle topconferenties met derde landen te wijzen op de staat van samenwerking met het Internationaal Strafhof; verzoekt om genoemde inspanningen uit te breiden tot het bevorderen van de ratificatie en tenuitvoerlegging van het Verdrag betreffende de privileges en immuniteiten van het Internationaal Strafhof, dat voor het functioneren van het Hof een belangrijk instrument is; wijst op de inwerkingtreding op 8 december 2007 van de overeenkomst met het Verenigd Koninkrijk inzake de tenuitvoerlegging van vonnissen (en de inwerkingtreding van een vergelijkbare overeenkomst die in 2005 met Oostenrijk is gesloten), en verzoekt alle lidstaten met klem een vergelijkbare overeenkomst met het Strafhof te sluiten; beschouwt de Overeenkomst tussen het Internationaal Strafhof en de Europese Unie inzake samenwerking en bijstand als een belangrijk middel tot aanvulling van de verplichtingen van afzonderlijke lidstaten;
30. Calls on the Council and the Commission to continue their vigorous efforts to promote universal ratification of the Rome Statute and the adoption of the requisite national implementing legislation, in conformity with Council Common Position 2003/444/CFSP of 16 June 2003 on the International Criminal Court and the Action Plan; points out that not all Council presidencies pursue this common goal with the same vigour; asks all presidencies to mention the status of the ICC cooperation in all summits with third countries; requests that such efforts be extended to include ratification and implementation of the Agreement on the Privileges and Immunities of the ICC, which is an important operational tool for the ICC; notes the entry into force on 8 December 2007 of the agreement with the United Kingdom on the enforcement of sentences (and the entry into force of a similar agreement concluded with Austria in 2005), and urges all Member States to consider concluding similar agreements with the ICC; acknowledges the Cooperation and Assistance Agreement between the European Union and the ICC as an important tool to supplement the obligations incumbent on individual Member States;
