Rekening houdend met de zeer lange aanlooptijden in de kernenergie-industrie, kan dit evenwel worden beschouwd als een initiële periode, waarna naar verwachting andere exploitanten klant kunnen worden van ETC. De Commissie is derhalve van mening dat de gezamenlijke onderneming duurzaam alle functies van een zelfstandige economische eenheid zal vervullen in de zin van artikel 3, lid 2, van de concentratieverordening en dat de voorgenomen operatie derhalve een concentratie vormt.
However, considering the particularly long lead times prevailing in the nuclear industry, this could be regarded as an initial period, after which other operators can be expected to become ETC’s customers. The Commission therefore considers that the joint venture will perform on a lasting basis all the functions of an autonomous economic entity within the meaning of Article 3(2) of the Merger Regulation and that the proposed operation thus constitutes a concentration.
