Het lidmaatschap van een ERIC staat open voor de lidstaten, geassocieerde landen, derde landen die geen geassocieerd land zijn, en intergouvernementele organisaties.
Membership of an ERIC is open to Member States, associated countries, third countries other than associated countries and intergovernmental organisations.

De Europese Commissie heeft besloten Duitsland een met redenen omkleed advies te sturen, omdat het bij de stemming tijdens de 25e zitting van de Herzieningscommissie van de Intergouvernementele Organisatie voor het Internationale Spoorwegvervoer (OTIF) een ander standpunt dan dat van de EU heeft ingenomen.De Commissie is van mening dat Duitsland, doordat het bij de stemming een standpunt heeft ingenomen dat afweek van het in Besluit 2014/699/EU van de Raad neergelegde EU-standpunt en doordat het zich openlijk van het EU-standpunt heeft gedistantieerd, zijn verplichtingen uit hoofde van dat besluit niet is nagekomen.Daardoor heeft het tevens gehandeld in strijd met zijn verplichting tot loyale samenwerking die is vastgelegd in artikel 4, lid 3, van het Verdrag betreffende de Europese Unie.
The European Commission has decided to send a reasoned opinion to Germany for voting in contradiction with the European Union's position during the 25 session of the Revision Committee of the Intergovernmental Organisation for International Carriage by Rail (OTIF). The Commission considers that by voting contrary to the European Union's position as established in Council Decision 2014/699/EU, and by openly distancing itself from the European Union's vote, Germany failed to fulfil its obligations under the said Decision. By doing so, it also failed to observe its duty of sincere cooperation enshrined in Article 4(3) of the Treaty on European Union.
