Regrets that, despite extensive preparation but in consequence of a loss of momentum caused by the impasse over the Lisbon Treaty, the revision of the ESS has resulted not in a new strategic orientation but merely in a report expressing day-to-day policy concerns as these arise; notes that the range of threats has been expanded to cover, inter alia, cyber security and piracy; welcomes innovative aspects of the revision such as its focus on climate change, energy security (including, in the nuclear field, support for a multilateral nuclear fuel cycle and a multilateral treaty banning the production of fissile material for nuclear weapons) and the International Arms Trade Treaty as well as other disarmament treaties such as the new Oslo Convention on Cluster Munitions;

Indien een verdragsluitende staat, nadat het verdrag voor hem in werking is getreden, een nieuwe collisieregel wenst vast te stellen voor een speciale categorie van overeenkomsten die onder het verdrag vallen, of wenst toe te treden tot een multilateraal verdrag op dat gebied, dient hij de andere staten die het verdrag hebben ondertekend, van zijn voornemen in kennis te stellen.
If, once the Convention has entered into force, any Member State wishes to adopt new rules on the choice of law for a particular category of contracts within the scope of the Convention, or become a party to an international convention in this field, it must inform the other signatories. Each of these States has six months to respond and, if it so wishes, ask for consultations.

Elk van deze staten heeft zes maanden de tijd om te reageren en eventueel om overleg te verzoeken. Indien binnen zes maanden geen enkele staat om overleg heeft verzocht of indien het overleg niet binnen twee jaar (één jaar voor een multilateraal verdrag) tot overeenstemming heeft geleid, kan de verdragsluitende staat zijn recht wijzigen of toetreden tot het verdrag.
If no reply has been received within six months or if no agreement has been reached in consultations within two years (one year in the case of a multilateral convention), the requesting State may amend its law or accede to the Convention.
