TRADUCTIONS EN CONTEXTE

De onregelmatigheden die bij enkele ESF-projecten geconstateerd zijn, blijven voor problemen zorgen. Op verzoek van de Commissie hebben de Nederlandse autoriteiten steekproefsgewijs enkele projecten onderzocht voor de jaren 1994-1996. Deze jaren waren nog niet eerder gecontroleerd. Op basis van deze studie heeft de Commissie besloten het onregelmatigheden percentage vast te stellen op 31,3% en dit percentage aan te houden bij het artikel 24-besluit om een aanzienlijk geldbedrag terug te vorderen. Verwacht wordt dat de Nederlandse autoriteiten de Commissie toestemming zullen vragen om de in de Verordening voorziene verlenging te gebruiken voor de afwikkeling van de periode 1994-1999 tegen uiterlijk eind maart 2003.
The irregularities found in a number of ESF projects continue to cause problems. At the request of the Commission the Dutch authorities have investigated a sample of projects for the years 1994-96, a period not hitherto inspected. On the basis of this study the Commission decided to fix the irregularity rate at 31.3% and to use this rate in the Article 24 decision to reclaim a substantial amount of money. The Netherlands has not submitted final payment claims for 1997-99 and the Dutch authorities are expected to ask the Commission for permission to use the extension provided by the Regulation to settle the 1994-99 period no later than the end of March 2003.

AB InBev changed the packaging of Jupiler and Leffe beer cans in the Netherlands and France to make it harder to sell them in Belgium: for example, it removed French text from its cans in the Netherlands, and Dutch text from its cans in France, to prevent their sale in the French and Dutch speaking parts of Belgium, respectively; AB InBev limited access of Dutch retailers to key products and promotions, in order to prevent them from bringing less expensive beer products to Belgium: for example, it did not sell and/or limited the quantity of certain products sold to Dutch retailers and restricted the availability of certain promotions, if there was a chance that the Dutch retailers could import the products into Belgium.

Daarnaast heeft de Commissie vandaag ook een verzoek van Nederland afgewezen om de fusie te verwijzen naar de Nederlandse mededingingsautoriteit met het oog onderzoek op grond van de Nederlandse mededingingswet.
In parallel, the Commission has today also rejected a request from the Netherlands to refer the merger to the Dutch competition authority for assessment under Dutch competition law.

24. Takes note of the review of the Dutch Intelligence and Security Act 2002 (report by the Dessens Commission of 2 December 2013); supports those recommendations of the review commission which aim to strengthen the transparency, control and oversight of the Dutch intelligence services; calls on the Netherlands to refrain from extending the powers of the intelligence services in such a way as to enable untargeted and large-scale surveillance also to be performed on cable-bound communications of innocent citizens, especially given the fact that one of the biggest Internet Exchange Points in the world is located in Amsterdam (AMS-IX); calls for caution in defining the mandate and capabilities of the new Joint Sigint Cyber Unit, as well as for caution regarding the presence and operation of US intelligence personnel on Dutch territory;
