Voorts is de rapporteur van mening dat, aangezien in de definitie van geregistreerde stoffen duidelijk staat dat een precursor slechts als geregistreerde stof kan worden beschouwd indien zij op een eenvoudige manier uit het mengsel kan worden geëxtraheerd, deze regeling het aantal geneesmiddelen die ooit als geregistreerde stof kunnen worden beschouwd en bijgevolg de impact van de verordening op de handel in geneesmiddelen sterk zou beperken.
Furthermore, since the definition of ‘scheduled substance’ stipulates that precursor must be easily extracted from the mixture in order to be considered as such, the rapporteur considers that this is likely to significantly restrict the number of medicinal products which may one day be deemed to be scheduled substances, and thus lessen the impact of the regulation on the trade in medicinal products.

S. whereas chemicals used for licit purposes can be diverted from the licit trade by criminal organisations and be used as drug precursors; whereas in 2008, 75 % of global seizures of acetic anhydride, the main drug precursor for heroin, occurred in the EU, while the annual reports of the UN’s International Narcotics Control Board continue to make reference to the insufficiently strict measures put in place by the EU to avert the diversion of this precursor chemical for illicit purposes;

An economic operator who intends to make available restricted explosives precursors to a member of the general public, shall ensure, either by affixing an appropriate label or by verifying that an appropriate label is affixed, that the packaging clearly indicates that the acquisition, possession or use of that restricted explosives precursor by members of the general public is subject to a restriction as set out in Article 4(1), (2) and (3).
