Hierbij delen wij u in naam van de Europese Centrale Bank (ECB) mee dat de Raad van bestuur van de ECB overeenkomstig artikel 2, lid 1, onder b), en artikel 2, lid 4, van Verordening (EU) nr. 1011/2012 (ECB/2012/24) [juridische benaming van groepsgegevens rapporterende informatieplichtige] voor statistische doeleinden als groepsgegevens rapporterende informatieplichtige heeft geclassificeerd.

The Governing Council of the ECB should invite the representatives from participating Member States whose currency is not the euro whenever it is contemplated by the Governing Council to object to a draft decision prepared by the Supervisory Board or whenever the concerned national competent authorities inform the Governing Council of their reasoned disagreement with a draft decision of the Supervisory Board, when such decision is addressed to the national authorities in respect of credit institutions from participating Member States whose currency is not the euro.

Rekening houdend met het scheidingsbeginsel en de instelling van de Raad van toezicht en de Administratieve Raad voor Toetsing, dienen twee aparte procedures van toepassing te zijn: a) indien de ECB het opleggen van administratieve boeten overweegt in het kader van uitoefening van haar toezichttaken, worden besluiten daartoe genomen door de Raad van bestuur van de ECB op basis van een compleet ontwerpbesluit van de Raad van toezicht en afhankelijk van toetsing door de Administratieve Raad voor Toetsing, en b) indien de ECB het opleggen van sancties overweegt in het kader van de uitoefening van haar niet-toezichttaken, worden besluiten daartoe genomen door de directie van de ECB, afhankelijk van toetsing door de Raad van bestuur van de ECB.
Taking account of the principle of separation and the establishment of the Supervisory Board and the Administrative Board of Review, two distinct procedures should apply: (a) where the ECB contemplates the imposition of administrative penalties in the exercise of its supervisory tasks, decisions to this effect are taken by the Governing Council of the ECB based on a complete draft decision from the Supervisory Board and subject to review by the Administrative Board of Review; and (b) where the ECB contemplates the imposition of sanctions in the exercise of its non-supervisory tasks, decisions to this effect are taken by the Executive Board of the ECB and subject to review by the Governing Council of the ECB.

8. Onverminderd artikel 6, verricht de raad van toezicht de voorbereiding met betrekking tot de aan de ECB opgedragen toezichttaken en legt hij de raad van bestuur van de ECB volledige ontwerpbesluiten voor ter aanneming door laatstgenoemde, volgens een in door de ECB vast te stellen procedure.
8. Without prejudice to Article 6, the Supervisory Board shall carry out preparatory works regarding the supervisory tasks conferred on the ECB and propose to the Governing Council of the ECB complete draft decisions to be adopted by the latter, pursuant to a procedure to be established by the ECB.
