Onverminderd lid 1 en de artikelen 9 en 10 mogen lidstaten bij de vaststelling van regels voor de selectieprocedure rekening houden met overwegingen die betrekking hebben op de volksgezondheid, de doelstellingen van het sociaal beleid, de gezondheid en de veiligheid van werknemers of zelfstandigen, de bescherming van het milieu, het behoud van cultureel erfgoed en andere dwingende redenen van algemeen belang, in overeenstemming met het Gemeenschapsrecht.

Subject to paragraph 1 and to Articles 9 and 10, Member States may take into account, in establishing the rules for the selection procedure, considerations of public health, social policy objectives, the health and safety of employees or self-employed persons, the protection of the environment, the preservation of cultural heritage and other overriding reasons relating to the public interest, in conformity with Community law.
