89. vraagt de lidstaten erop toe te zien dat hun wetgeving met name inzake nationale veiligheid, voorziet in een veilige mogelijkheid om misstanden als corruptie, strafbare delicten, verzuim van wettelijke plichten, gerechtelijke dwalingen, en misbruik van gezag, in plaats van te verzwijgen, te onthullen of te melden, wat ook zou aansluiten op de bepalingen van verschillende internationale (VN en Raad van Europa) instrumenten tegen corruptie, de beginselen in de PACE Resolutie 1729 (2010), de Tshwane-beginselen enz.;
89. Calls on the Member States to ensure that their legislation, notably in the field of national security, provides a safe alternative to silence for disclosing or reporting of wrongdoing, including corruption, criminal offences, breaches of legal obligation, miscarriages of justice and abuse of authority, which is also in line with the provisions of different international (UN and Council of Europe) instruments against corruption, the principles laid out in the PACE Resolution 1729 (2010), the Tshwane principles, etc.;

77. bepleit de oprichting van een groep op hoog niveau die op transparante wijze en in samenwerking met de parlementen, aanbevelingen moet uitbrengen voor verscherpt democratisch toezicht, ook parlementair toezicht, op inlichtingendiensten, en voor nauwere samenwerking op het gebied van toezicht in de EU, met name ten aanzien van de grensoverschrijdende dimensie; is van mening dat de groep zich in het bijzonder moet buigen over de mogelijkheid om Europese minimumnormen of richtsnoeren vast te stellen inzake (ex ante- en ex post-) toezicht op inlichtingendiensten op grond van bestaande beste praktijken en aanbevelingen van internationale organen (VN, Raad van Europa), met inbegrip van de kwestie dat toezichtsorganen als derde partij worden beschouwd, volgens het „beginsel van de derde partij” of het „beginsel van controle door afzender”, met het oog op de controleerbaarheid en de verantwoording van inlichtingen uit derde landen, criteria voor een grotere transparantie, voortbouwend op het algemene beginsel van toegang tot informatie en de zogenaamde „Tshwane-beginselen” , alsmede beginselen inzake beperkingen voor de duur en de reikwijdte van elke observeringsactiviteit, om te waarborgen dat ze in verhouding staan en beperkt blijven tot het doel ervan;
77. Calls for the setting up of a Group of Members and experts to examine, in a transparent manner and in collaboration with national parliaments, recommendations for enhanced democratic oversight, including parliamentary oversight, of intelligence services and increased oversight collaboration in the EU, in particular as regards its cross-border dimension; considers that the group should examine, in particular, the possibility of minimum European standards or guidelines for the (ex ante and ex post) oversight of intelligence services on the basis of existing best practices and recommendations by international bodies (UN, Council of Europe), including the issue of oversight bodies being considered as a third party under the ‘third party rule’, or the principle of ’originator control’, on the oversight and accountability of intelligence from foreign countries, criteria on enhanced transparency, built on the general principle of access to information and the so-called ‘Tshwane Principles’ , as well as principles regarding the limits on the duration and scope of any surveillance ensuring that they are proportionate and limited to its purpose;
