H. overwegende dat een belangrijke reden voor de hongerstaking volgens de advocaten van de verdediging en het Internationaal Comité van het Rode Kruis de wanhoop is van de gevangenen over het ontbreken van enig perspectief op vrijlating, in het bijzonder nadat president Obama in januari de National Defence Authorization Act (NDAA) heeft ondertekend, met bepalingen over de instandhouding van Guantánamo Bay in de nabije toekomst;
H. considérant que les avocats de la défense et le CICR font valoir que la grève de la faim s'explique essentiellement par la détresse des détenus face à l'absence de toute perspective de libération, notamment après la reconduction par le Président Obama, en janvier 2013, de la loi sur la défense nationale (National Defence Authorisation Act, ou NDAA) qui contient des dispositions maintenant le centre de Guantanamo dans un futur proche;

H. overwegende dat de National Defence Authorization Act het voor de gevangenen praktisch onmogelijk maakte naar huis terug te keren, aangezien hierin staat dat gedetineerden niet kunnen terugkeren naar een land waar een "risico bestaat dat waarschijnlijk van aanzienlijke invloed is" op de mogelijkheid voor de regering om "controle uit te oefenen" over de teruggekeerde persoon;
