8. a) Op 19 februari 2016 initieerde Zuid-Afrika op vraag van de South African Poultry Association (SAPA), een procedure onder de vrijwaringsclausule voor landbouwproducten van het bilaterale Akkoord tussen de EU en Zuid-Afrika (Agreement on Trade, Development and Cooperation between the EU and the Republic of South Africa, TDCA).

F. considérant l'article XX de l'Accord général sur les tarifs douaniers et le commerce de 1994 (le GATT de 1994) selon lequel: « [s]ous réserve que ces mesures ne soient pas appliquées de façon à constituer soit un moyen de discrimination arbitraire ou injustifiable entre les pays où les mêmes conditions existent, soit une restriction déguisée au commerce international, rien dans le présent accord ne sera interprété comme empêchant l'adoption ou l'application par toute partie contractante des mesures [.] b) nécessaires à la protection de la santé et de la vie des personnes et des animaux ou à la préservation des végétaux; [.] d) nécessaires pour assurer le respect des lois et règlements qui ne sont pas incompatibles avec les dispositions du présent accord, tels que, par exemple, les lois et règlements qui ont trait à l'application des mesures douanières [.]; g) rapportant à la conservation des ressources naturelles épuisables, si de telles mesures sont appliquées conjointement avec des restrictions à la production ou à la consommation nationales; [.] »;

De verklaring voorziet in haar vierde paragraaf dat de lidstaten het recht hebben om het TRIPS-akkoord vrij te interpreteren om noden op het gebied van volksgezondheid te ledigen, inzonderheid toegang tot geneesmiddelen : « the TRIPS Agreement does not and should not prevent members from taking measures to protect public health. accordingly, while reiterating our commitment to the TRIPS Agreement, we affirm that the Agreement can and should be interpreted and implemented in a manner supportive of WTO members » right to protect public health and, in particular, to promote access to medicines for all».
Le paragraphe 4 se lit comme suit : « Nous convenons que l'Accord sur les ADPIC n'empêche pas et ne devrait pas empêcher les membres de prendre des mesures pour protéger la santé publique. En conséquence, tout en réitérant notre attachement à l'Accord sur les ADPIC, nous affirmons que ledit accord peut et devrait être interprété et mis en œuvre d'une manière qui appuie le droit des membres de l'OMC de protéger la santé publique et, en particulier, de promouvoir l'accès de tous aux médicaments».
