TRADUCTIONS EN CONTEXTE

Volgens de bestaande mededeling inzake de filmsector (zie IP/01/1326) kan deze soort staatssteun in aanmerking komen voor de cultuurderogatie van het algemene verbod op staatssteun van het Verdrag indien aan de volgende criteria is voldaan:

De Commissie is echter van mening dat het vrijstellingsmechanisme louter exploitatiesteun vormt en dus niet in aanmerking komt voor de toepassing van een uitzondering op de algemene beginselen betreffende het verbod op staatssteun zoals neergelegd in het VWEU.
La Commission estime toutefois qu’aucune des dérogations au principe général d’interdiction des aides d’État prévues dans le TFUE n’entre en considération pour le mécanisme d’exemption, qui constitue purement et simplement une aide au fonctionnement.

Noch binnen de richtsnoeren landbouw, noch binnen andere regelingen op het gebied van de landbouw zijn voor de bovengenoemde maatregelen expliciete uitzonderingen resp. vrijstellingen te vinden ten aanzien van het principiële verbod op staatssteun conform artikel 87, lid 1, van het EG-Verdrag.
Toutefois, ni ces lignes directrices, ni aucune autre règle relative à l’agriculture ne prévoient, en ce qui concerne les mesures décrites ci-dessus, des dérogations expresses à l’interdiction de principe concernant les aides établie à l’article 87, paragraphe 1, du traité CE.

De Commissie heeft getoetst of een van de uitzonderingen op of vrijstellingen van het principieel geldende verbod op staatssteun, conform artikel 87, lid 1, van het EG-Verdrag hier van toepassing is.

In het licht van het bovenstaande is de Commissie van oordeel dat geen enkele uitzondering op het verbod van staatssteun aan de scheepsbouwsector van toepassing is in onderhavig geval, dat de maatregel als staatssteun moet worden aangemerkt en dat hij onverenigbaar is met de gemeenschappelijke markt.
Compte tenu des observations susmentionnées, la Commission estime qu'en l'espèce, aucune des dérogations à l’interdiction d’octroyer des aides d’État au secteur de la construction navale n'est applicable et que, partant, la mesure, qui présente les caractéristiques essentielles de l’aide d’État, est incompatible avec le marché commun.

(247) Aangezien geen van de uitzonderingen van het verbod op staatssteun van artikel 87, lid 1, van het EG-Verdrag van toepassing is, is de onderhavige staatssteun niet verenigbaar met de bepalingen van het Verdrag.

Het Verdrag voorziet in een aantal uitzonderingen op het algemene verbod op staatssteun.

De Commissie heeft verschillende beschikkingen gegeven die haar wil om streng op te treden illustreren: verbod op een overeenkomst tot informatie-uitwisseling (Wirtschaftsvereiningung Stahl), vrijstelling van overeenkomsten na wijzigingen (Unisource/Uniworld), veroordeling en een boete wegens misbruik van een machtspositie (Irish Sugar), verbod van een concentratie (Blokker/Toys'r Us), voorwaardelijke goedkeuring van zeven andere concentraties (waaronder Boeing/McDonnell Douglas), drie beschikkingen betreffende onverenigbaarheid in het licht van artikel 90 en negen negatieve eindbeschikkingen op het gebied van staatssteun.
La Commission a adopté plusieurs décisions qui illustrent sa volonté de rigueur: interdiction d'un accord d'échange d'informations (Wirtschaftsvereiningung Stahl), exemption d'accords après modification (Unisource/Uniworld), condamnation avec amende d'abus de position dominante (Irish Sugar), interdiction d'une concentration (Blokker/Toys'r Us), autorisation sous conditions de sept autres concentrations (dont Boeing/McDonnell Douglas), trois décisions d'incompatibilité sous l'angle de l'article 90 et neuf décisions finales négatives en matière d'aides d'état.
