The Steering Board, in the context of Agency ad hoc projects and programmes, may authorise the Agency, under the conditions set out in the arrangements governing the activities in question, to enter into contracts and grant agreements, and collect the necessary contributions from these Member States in advance to honour such contracts and grant agreements.

5. Where controls or audits demonstrate systemic or recurrent errors, irregularities, fraud or breach of obligations attributable to the beneficiary and having a material impact on a number of grants awarded to that beneficiary under similar conditions, the authorising officer responsible may suspend implementation of all the grants concerned or, where appropriate, terminate the concerned grant agreements or decisions with that beneficiary, in proportion to the seriousness of the errors, irregularities, fraud or of the breach of obligations, provided that the beneficiary has been given the opportunity to make observations.

Si des contrôles ou audits révèlent l'existence d'erreurs, d'irrégularités, de fraudes ou de violations des obligations systémiques ou récurrentes imputables au bénéficiaire et ayant une incidence matérielle sur plusieurs subventions qui ont été octroyées audit bénéficiaire dans des conditions similaires, l'ordonnateur compétent peut suspendre la mise en œuvre de toutes les subventions concernées ou, le cas échéant, résilier les conventions ou décisions de subvention concernées passées avec ce bénéficiaire, en proportion de la gravité des erreurs, des irrégularités, des fraudes ou des violations des obligations, à condition que le bénéficiaire ait eu la possibilité de présenter des observations.

The terms and conditions of these grant agreements shall be in accordance with the financial rules of the ARTEMIS Joint Undertaking and shall refer to and, where appropriate, rely on corresponding national grant agreements as referred to in Article 16(5)(b).
