According to the preliminary assessment, Alcan's practice of contractually tying the licences of its Aluminium Pechiney (‘AP’) aluminium smelting (reduction) technology to the purchase of certain speciality cranes for aluminium reduction plants, so-called pot tending assemblies (PTAs), supplied by Alcan's subsidiary Electrification Charpente Levage SASU (‘ECL’), may result in an infringement of Articles 101 and 102 of the TFEU and Articles 53 and 54 of the EEA Agreement.
Selon l’évaluation préliminaire, la pratique d'Alcan consistant à lier contractuellement l'octroi de licences sur sa technologie de fusion de l'aluminium (réduction), dite Aluminium Pechiney (ci-après «AP»), à l'acquisition de certaines grues spéciales pour les installations de réduction de l'aluminium, appelées dispositifs de piquage et d’alimentation (ci-après «DPA»), produites par Electrification Charpente Levage SASU (ci-après «ECL»), une filiale d'Alcan, peut conduire à une infraction aux articles 101 et 102 du TFUE et aux articles 53 et 54 de l'accord EEE.
