The Commission considers that the requirements in paragraph 2 of section Α of the single article of Ministerial Decision No 109088/12.12.2011, in accordance with which the mediation training certificate must confirm the teaching methods, the number of participants, the number and qualifications of the trainers, the procedure for the examination and evaluation of candidates and the means of ensuring the integrity of that procedure, exceed what can be required for the evaluation of the level of professional knowledge and qualifications which the certificate-holder is certified to possess and do not permit a correct assessment of the question whether the training of the person concerned covers matters that are substantially different from those covered by the required accreditation in Greece.
La Commission estime que l’exigence figurant au paragraphe 2 du chapitre premier de l’article unique de l’arrêté ministériel no 109088/12 décembre 2011, selon lequel le certificat de formation du médiateur doit attester les méthodes d’enseignement, le nombre de participants, le nombre d’enseignants et leurs qualifications, la procédure d’examen et d’évaluation des candidats et la manière dont est assurée l’intégrité de cette procédure vont au-delà de ce qui peut être exigé pour apprécier le niveau des connaissances et des qualifications professionnelles que le titulaire est présumé posséder et ne permettent pas d’apprécier correctement la question de savoir si la formation de l’intéressé porte sur des domaines de connaissances en substance différents de ceux qui sont couverts par le titre de formation exigé en Grèce.

18. A candidate is required, within a period of seven years after the date on which the candidate’s application is accepted, to pass all the examinations prescribed by the Board of Examiners after an evaluation of the candidate’s qualifications, or to demonstrate to the Board of Examiners that the candidate has received equivalent training.

No doubt can be cast on that conclusion by the applicant’s arguments concerning a hypothetical right of candidates in a competition to have access to their marked written tests, based on the Ombudsman’s recommendation to the Commission of 18 October 1999, on acceptance of that recommendation by the Commission and on the Ombudsman’s inquiry, commenced in 2005, which ended in a further recommendation to the Commission regarding the latter’s obligation to provide information regarding the evaluation criteria to any candidates who request it.
