TRADUCTIONS EN CONTEXTE

Notwithstanding paragraph 2, if the ESM unanimously requests the ECB to take over direct supervision of a credit institution, financial holding company or mixed financial holding company as a precondition for its direct recapitalisation, the ECB may immediately start carrying out the tasks conferred on it by this Regulation in respect of that credit institution, financial holding company or mixed financial holding company, and following a decision addressed to the entities concerned and to the national competent authorities concerned.

3. Notwithstanding paragraph 2, and without prejudice to the exercise of investigatory powers conferred on it under this Regulation, from 3 November 2013, the ECB may start carrying out the tasks conferred on it by this Regulation other than adopting supervisory decisions in respect of any credit institution, financial holding company or mixed financial holding company and following a decision addressed to the entities concerned and to the national competent authorities concerned.
3. Nonobstant le paragraphe 2, et sans préjudice des pouvoirs d’enquête qui lui sont conférés en vertu du présent règlement, à compter du 3 novembre 2013, la BCE peut commencer à s’acquitter des missions que lui confie le présent règlement - autres que l’adoption de décisions en matière de surveillance - concernant tout établissement de crédit, toute compagnie financière holding ou toute compagnie financière holding mixte, et à la suite d’une décision adressée aux entités concernées et aux autorités compétentes nationales concernées.

Nothing in this Regulation should be understood as conferring on the ECB the power to impose penalties on natural or legal persons other than credit institutions, financial holding companies or mixed financial holding companies, without prejudice to the ECB’s power to require national competent authorities to act in order to ensure that appropriate penalties are imposed.
Aucune disposition du présent règlement ne devrait s’entendre comme conférant à la BCE le pouvoir d’imposer des sanctions à des personnes physiques ou morales autres que des établissements de crédits, des compagnies financières holdings ou des compagnies financières holdings mixtes, sans préjudice du pouvoir de la BCE de demander aux autorités compétentes nationales qu’elles agissent pour assurer que des sanctions appropriées soient imposées.

1. For the purpose of carrying out its tasks referred to in Article 4(1) and without prejudice to other powers conferred on the ECB, the ECB shall have the powers set out in paragraph 2 of this Article to require any credit institution, financial holding company or mixed financial holding company in participating Member States to take the necessary measures at an early stage to address relevant problems in any of the following circumstances:
1. We have held systematic interparliamentary conferences, because we have to work together, with Members and Senators of the Parliaments of each country, and I hope that the custom of holding conferences during each Presidency that enable us to work together will continue.

Calls on the Commission, the Council and Member States to start the process of modernisation of the Charter and re-launch the implementation process with priorities of the Lisbon agenda; considers that revision of Charter should be the focus of the next annual conference on the Charter; welcomes the practice followed hitherto of holding conferences on the Charter, such as those held in Dublin (2004) and Luxembourg (2005); is in favour of the practice of holding national conferences on the Charter and recommends that the mechanism for submitting reports regarding the Charter be linked to progress reports on the Entrepreneurship Action Plan;
31. demande à la Commission, au Conseil et aux États membres de lancer le processus de modernisation de la Charte et de donner un nouvel élan au processus de mise en œuvre en tenant compte des priorités de l'agenda de Lisbonne; estime que la révision de la Charte devrait être au centre de la prochaine conférence annuelle sur la Charte; souscrit à la pratique suivie jusqu'à présent, consistant à organiser des conférences sur la Charte, telles que celles de Dublin (en 2004) et de Luxembourg (en 2005); soutient l'organisation de conférences nationales sur la Charte et recommande que le mécanisme de soumission de rapports sur la Charte s'articule avec les rapports sur l'état d'avancement du plan d'action pour l'esprit d'entreprise;

31. 67. On the other hand, the provisions on freedom of establishment within the meaning of Article 43 of the Treaty must be applied when a public authority decides, by means of a capital transaction, to cede to a third party a holding conferring a definite influence in a public entity providing economic services normally falling within the responsibility of the State.
