Deplores the fact that the Charter of Fundamental Rights has not been adopted in all Member States, and that many people have found its implementation to be unclear and, to some extent, disappointing; deplores as well the fact that the European Convention on Human Rights has not yet been adopted by the EU as such within the meaning of Article 6(2) TEU, and that European citizens do not have access to sufficient information concerning the procedures in place in this regard; deplores the strict way in which the Commission has interpreted Article 51 of the Charter of Fundamental Rights, with its stipulation that the provisions of the Charter be addressed to the institutions, bodies, offices and agencies of the Union with due regard for the principle of subsidiarity and to the Member States only when they are implementing Union law; recalls that the Commission has often said it is unable to act in the area of fundamental rights, when the Committee has so requested, citing Article 51 of the Charter; stresses the fact that the expectations of citizens often go beyond what the Charter’s strictly legal provisions allow for; calls on the Commission to do more to meet citizens’ expectations and to find a new approach to the interpretation of Article 51;

In its answer it confirms that ‘field of activity’ as contained in the Treaty, ‘can be considered to be even wider than the mere sum of the competencies exercised by the Union’. Amongst the implications of this, the fact that the Commission (which frequently conducts preliminary investigations regarding admissible petitions at the request of the Committee) only acts ‘within the competencies of the Union’ means that its interpretation of petitions is often narrower than the scope for interpretation of petitions offered to the Parliament and its Petitions Committee.

If an entity applies this Interpretation for a period beginning before 1 July 2009, it shall disclose that fact and also apply IFRS 3 (as revised in 2008), IAS 27 (as amended in May 2008) and IFRS 5 (as amended by this Interpretation).

In view of the fact that the application of the regulatory procedure with scrutiny within the usual deadlines could in certain exceptional situations make it difficult to adopt newly issued accounting standards, amendments to existing accounting standards or interpretations of existing accounting standards in time for them to be applied by undertakings for the relevant financial year, the European Parliament, the Council and the Commission should act speedily in order to ensure that those standards and interpretations are adopted in a timely manner so as not to undermine investor understanding and confidence.

Whilst respecting the fact that the ultimate responsibility for interpreting the notion of "evidence" lies with the European Court of Justice,[5] the Commission is of the view that this concept should be interpreted autonomously and that in order to achieve the objectives of the Regulation, the scope of application of the Regulation should not be limited unnecessarily by a too narrow interpretation.

The wide interpretation given to the definition of the term 'animal by-products' in Regulation (EC) No 1774/2002 (products 'not intended for human consumption') is in reality leading to treatment in accordance with the provisions of that Regulation being demanded even in the case of feed products (e.g. milk powder).
