The Commission assessed the price undercutting during the review investigation period by comparing the weighted average sales prices per product type of the three sampled Union producers charged to unrelated customers on the Union market, adjusted to an ex-works level; and the corresponding weighted average prices at CIF Union frontier level per product type of the imports from the sampled producers to the first independent customer on the Union market, with appropriate adjustments for post-importation costs. The price comparison was made on a type-by-type basis for transactions, duly adjusted where necessary, and after deduction of rebates and discounts.

3. 4. Where the market surveillance authorities of a Member State, as defined in Regulation (EC) No 765/2008, intend to carry out sample checks they may, when reasonable and practicable, request the manufacturer to make the necessary samples available or to give on-the-spot access to the samples at the manufacturer's own cost .

Sampling criteria and testing procedures should be defined in advance. In particular if a sampling in the manufacturer’s premises is not possible, notified bodies should take samples from the market, if necessary with support by the competent authorities, or should perform testing on a device installed at a customer location.

It happens also for small electrical components such as electrical controls, switchgears or small measuring instruments. Therefore, when customs authorities have a serious reason to believe that the imported product may not be in compliance with all EU requirements, they should be entitled to seize samples of the product in order to speed up the control by market surveillance authorities and ensure possible legal action against the importer or the manufacturer’s authorised representative in case of characterised default of compliance with EU legislation.

Food and feed falling within the scope of this Regulation which have been lawfully placed on the Community market before the date of application of this Regulation should continue to be allowed on the market, subject to the transmission to the Commission by the operators of information concerning the risk assessment, methods for sampling, identification and detection as appropriate, including the transmission of samples of the food and feed and their control samples within six months after the date of application of this Regulation.

Conducting the necessary tests and trials with a view to application of paragraphs 1, 3 and 4 as well as for export, the submission of an application, the submission of samples in accordance with Article 19, as well as the granting of a marketing authorisation for a generic medicinal product shall not be regarded as contrary to patent rights or to complementary protection certificates for those reference medicinal products.
