The competent authority shall ensure that the provisions of this Regulation are applied on its territory, regarding all actions carried out on its territory, and actions carried out abroad relating to instruments admitted to trading on a regulated market, for which a request for admission to trading on such market has been made, auctioned on an auction platform or which are traded on an MTF or an OTF or for which a request for admission to trading has been made on an MTF operating within its territory.
L’autorité compétente veille à l’application des dispositions du présent règlement sur son territoire, en ce qui concerne l’ensemble des actions réalisées sur son territoire et les actions réalisées à l’étranger se rapportant à des instruments admis à la négociation sur un marché réglementé, pour lesquels une demande d’admission à la négociation sur un tel marché a été introduite, mis aux enchères sur une plate-forme d’enchères ou qui sont négociés sur un MTF ou sur un OTF ou pour lesquels une demande d’admission à la négociation a été présentée sur un MTF opérant sur son territoire.

6. Member States shall, without further legal or administrative requirement, allow investment firms and market operators operating MTFs and OTFs from other Member States to provide appropriate arrangements on their territory so as to facilitate access to and trading on those markets by remote users, members or participants established in their territory.
6. Chaque État membre autorise, sans autre exigence juridique ou administrative, les entreprises d’investissement et les opérateurs de marché exploitant des MTF et OTF d’autres États membres à prendre les dispositions appropriées sur son territoire pour permettre aux utilisateurs, aux membres et aux participants qui y sont établis d’accéder à ces marchés et d’y négocier à distance.

By analogy with the case-law on public procurement and concessions which provides that the in-house operator’s activities should not be ‘market-oriented’ (22), the condition of Article 5(2)(b) that ‘the internal operator [.] perform their public passenger transport activity within the territory of the competent local authority, [.] and do not take part in competitive tenders concerning the provision of public passenger transport services organised outside the territory of the competent local authority’ should be interpreted as follows: the internal operator or the entity influenced by the internal operator must not operate public passenger transport services, including as a subcontractor, or participate in tender procedures outside the competent authority’s territory within the Union or, due to a possible indirect effect on the internal market, elsewhere in the world.

As regards derivative instruments not admitted to trading but falling within the scope of this Directive, each Member State should be competent to sanction actions carried out on its territory or abroad which concern underlying financial instruments admitted to trading on a regulated market situated or operating within its territory or for which a request for admission to trading on such a regulated market has been made.
Pour ce qui est des instruments dérivés qui ne sont pas admis à la négociation mais qui relèvent du champ d'application de la présente directive, chaque État membre devrait être compétent pour sanctionner les actes accomplis sur son territoire ou à l'étranger et qui concernent des instruments financiers sous-jacents admis à la négociation sur un marché réglementé situé ou opérant sur son territoire ou pour lesquels a été présentée une demande d'admission à la négociation sur ce marché réglementé.
