Emphasises the current lack of coherent administrative law for EU institutions, bodies, offices and agencies, such as rules regarding the delivery of administrative decisions that can be appealed against , or a clear concept of ‘administrative tasks’ as mentioned in Article 15(3) TFEU; calls, therefore, on the EU institutions to urgently define a common EU administrative law pursuant to Article 298 TFEU, and to provide a common and horizontally applicable definition of an ‘administrative task’, especially for the European Central Bank, the European Investment Bank and the Court of Justice; asks the Commission to provide a legislative proposal on this issue, pursuant to Article 225 TFEU, which should, inter alia, address the issue of the transparency and accountability of the Commission's conduct of infringement proceedings vis-à-vis complainants, the Parliament and citizens;

Of course, it is absolutely true that there has to be a balance, a proportionality, that citizens’ rights and privacy rights must not be sacrificed beyond measure and that the possibility for citizens to lodge an appeal, either an administrative appeal or a legal appeal, against any decisions taken on the basis of the SWIFT system must, of course, be guaranteed – just as this new wording by the Commission, which has accepted many of the most important points made by the European Parliament, guarantees.

G. whereas Israel is currently holding around 730 Palestinian prisoners, including 13 children, in 'administrative detention' without charge or trial, authorised by administrative channels rather than by judicial decree; whereas Israel disregards the restrictions imposed by law on the application of 'administrative detention'; whereas whilst detainees may appeal against their detention, neither they nor their attorneys are allowed access to the evidence against them; whereas Israel has never defined the criteria for what constitutes 'state security',
