The decision was taken in recognition of the progress on reforms achieved by Turkey and provided that key pieces of legislation would enter into force and the Protocol extending the Ankara Agreement to the new Member States would be signed before opening negotiations.[1]

The Council also noted with deep regret that Turkey has yet to implement the Additional Protocol to the Association Agreement, the so-called Ankara Protocol, and that it has not made sufficient progress towards normalisation of its relations with the Republic of Cyprus.

The same applies when he speaks of institutional reforms, the same applies when he speaks of a peaceful resolution to differences and the same applies when he calls for the signature of the Ankara protocol to be honoured and for this protocol to be applied immediately.

The Turkish Foreign Minister, Abdullah Gül, has recently stated that Turkey will not implement the Council´s decision to extend the Ankara Protocol to Cyprus (a.k.a. the Customs Union Protocol), unless the EU approves the Direct Trade Regulation with the Turkish Cypriot Community.

Considering that the Association relations as provided for in Article 5 of the Ankara Agreement are entering into their final phase based on the Customs Union, which will complete the transitional phase through the fulfilment by the two parties of their reciprocal obligations and which leads to the elaboration of the modalities for the effective functioning of the Customs Union within the framework of the Ankara Agreement and Additional Protocol;
considérant que les relations d'association au sens de l'article 5 de l'accord d'Ankara entrent dans leur phase finale, fondée sur l'union douanière, qui mettra fin à la phase transitoire, les deux parties contractantes s'acquittant de leurs obligations réciproques, et qui conduira à l'élaboration des modalités d'un fonctionnement effectif de l'union douanière dans le cadre de l'accord d'Ankara et du protocole additionnel;
