Following the removal of epizootic ulcerative syndrome from the list in Part II of Annex IV to Directive 2006/88/EC the corresponding animal health provisions applicable to India and Vietnam have become redundant and therefore those countries should be removed from the list of countries that are to apply disease specific animal health measures to aquatic animals intended for export to the Union.
Suite à la suppression de la mention du SUE de la liste figurant à l’annexe IV, partie II, de la directive 2006/88/CE, les dispositions de police sanitaire correspondantes applicables à l’Inde et au Viêt Nam devenant superflues, il convient d’enlever ces pays de la liste des États tenus d’appliquer les mesures de police sanitaire spécifiques à cette maladie aux animaux aquatiques destinés à l’exportation vers l’Union.

As to the continuation of subsidisation, the applicant alleges that the producers of the product under review in India have benefited and will continue to benefit from a number of subsidies granted by the Government of India.

Commission Decision 2010/381/EU of 8 July 2010 on emergency measures applicable to consignments of aquaculture products imported from India and intended for human consumption (3) provides that at least 20 % of the consignments of aquaculture products from India intended for human consumption are to be tested for the presence of pharmacologically active substances as defined in Article 2(a) of Regulation (EC) No 470/2009 of the European Parliament and of the Council (4), and in particular of chloramphenicol, tetracycline, oxytetracycline and chlortetracycline and of metabolites of nitrofurans.

Commission Decision 2009/727/EC of 30 September 2009 on emergency measures applicable to crustaceans imported from India and intended for human consumption or animal feed (5) already provides that consignments of crustaceans of aquaculture origin introduced from India and intended for human consumption or animal feed are to be tested for the presence of nitrofurans or their metabolites before they are imported into the Union.
La décision 2009/727/CE de la Commission du 30 septembre 2009 sur les mesures d’urgence applicables aux crustacés importés de l’Inde et destinés à la consommation humaine ou à l’alimentation animale (5) prévoit déjà que les lots de crustacés issus de l’aquaculture importés d’Inde et destinés à la consommation humaine ou à l’alimentation animale doivent être analysés pour détecter la présence de nitrofuranes ou de leurs métabolites avant qu’ils ne soient importés dans l’Union.

3. Where licence applications reach or exceed the quantity of one of the delivery obligations by country concerned fixed under Article 12 in the case of ACP/India sugar, or of one of the tariff quotas in the case of other sugars, the Commission shall fix an allocation coefficient in proportion to the quantity available which the Member States shall apply to each application.

In the case of the preferential sugar referred to in the ACP Protocol and in the Agreement with India, given that unforeseeable delays may occur between the loading of a consignment of sugar and its delivery, a certain tolerance should be permitted in the application of the delivery periods to take account of such delays.

For ACP/India sugar, the first period for submission of applications for import licences shall start on the Monday before 10 June of the previous delivery period.

4. If the Commission has informed the Member States that the limit for accepting applications for licences has been reached and that the records referred to in paragraph 2 indicate that quantities of sugar are still available for the delivery obligations in respect of ACP/India sugar or for the tariff quotas in the case of other sugars, the Commission shall inform the Member States that the limit in question has no longer been reached.
4. Dans le cas où la Commission a informé les États membres que la limite de la recevabilité des demandes de certificats est atteinte et que la comptabilisation visée au paragraphe 2 fait apparaître que des quantités de sucre sont encore disponibles pour les obligations de livraison de sucre ACP/Inde ou pour des contingents tarifaires des autres sucres, la Commission informe les États membres que la limite concernée n'est plus atteinte.
