TRADUCTIONS EN CONTEXTE

In the light of this decision and of its findings on the competitive state of these international markets, the Commission will also review current submissions concerning the lifting of conditions attached to other decisions it has taken in this area, in particular the Atlas/GlobalOne decisions, in order to further foster competition.
A la lumière de cette décision et des résultats de son enquête sur l'état de la concurrence sur ces marchés internationaux, la Commission va également examiner les demandes reçues relatives à la levée des conditions attachées à d'autres décisions prises dans ce domaine, en particulier les décisions Atlas/GlobalOne, afin de renforcer davantage la concurrence.

The present approval follows the clearance of the previous alliances between BT and MCI (Concert) and France Telecom, Deutsche Telekom and Sprint (Atlas/GlobalOne).
La présente approbation fait suite à l'autorisation des alliances précédentes entre BT et MCI (Concert), et France Télécom, Deutsche Telekom et Sprint (Atlas/GlobalOne).

The Commission attaches the following conditions to Atlas/GlobalOne: - FT and DT must establish and maintain access to their domestic public switched data networks in France and Germany, even after their integration into Atlas, on a non-discriminatory, open and transparent basis to all service providers offering low-level data services (i.e. using protocols such as X.25, Frame Relay, Internet or SNA); to ensure continued non-discriminatory access in the future, they must also implement any generally applied standardised interconnection standard that may modify, replace or co-exist with, the current standard; - FT and DT must treat Atlas/GlobalOne and all third party competitors in a non-discriminatory way in relation to their facilities; this condition extends to the availability of facilities-related services, to the terms and conditions of service provision and to relevant information on such services; - FT and DT are prohibited from any cross-subsidisation; to prevent cross-subsidies, all entities formed pursuant to the Atlas and GlobalOne ventures are established as distinct entities, separate from the parent companies; FT, DT and their joint entities must implement an analytical accounting system, subject to regular external auditing, to ensure that these entities deal with FT or DT on an arm's length basis at all times; - FT and DT acting as Atlas/GlobalOne's distributors in France and Germany must conclude separate one separate contract for their own services and one for the distributed Atlas/GlobalOne services respectively; each of the two contracts must identify the price and the rebate, if any, of each individual service provided; - FT must sell INFO AG, an important competitor of T-Data on the German data network services market, before a specified deadline.
La Commission attache les conditions suivantes à Atlas / GlobalOne: - FT et DT doivent établir et maintenir l'accès à leurs réseaux informatiques commutés publics domestiques en France et en Allemagne, même après leur intégration dans Atlas, sur une base non discriminatoire, ouverte et transparente, pour tous les prestataires de services offrant des services de données de bas niveau (c'est-à-dire utilisant des protocoles tels que X.25, 'frame-relay', Internet ou SNA). Pour assurer la continuité d'un accès non discriminatoire à l'avenir, ils doivent également mettre en oeuvre toute norme d'interconnexion normalisée généralement acceptée, qui peut modifier, remplacer ou coexister avec la norme en vigueur; - FT et DT doivent traiter Atlas / GlobalOne et tous les concurrents tiers d'une manière non-discriminatoire concernant leurs installations. Cette condition s'étend à la disponibilité des services relatifs aux installations, aux modalités et aux conditions de la fourniture de ces services et à l'information appropriée sur de tels services; - FT et DT ne peuvent pratiquer de subventions croisées. Pour empêcher les subventions croisées, toutes les entités constituées conformément aux projets ATLAS et PHOENIX sont établies comme entités distinctes, séparées des sociétés mères. FT, DT et leurs entités communes doivent mettre en oeuvre un plan de comptabilité analytique, soumis à une vérification externe régulière, pour s'assurer que les transactions entre ces entités et France Télécom et Deutsche Telekom ont lieu sur une base commerciale normale ("at arm's length"); - FT et DT agissant en tant que distributeurs d'Atlas / GlobalOne en France et en Allemagne doivent conclure des contrat distincts respectivement pour leurs propres services et pour ceux distribués pour Atlas / GlobalOne. The Commission decisions set out a two-tier approval: i Atlas/GlobalOne's European and global services as well as most value- added services in France and Germany are authorised from the date on which France and Germany grant the first two alternative telecommunications infrastructure licences.

At the proposal of Mr Karel van Miert, Commissioner in charge of EU competition policy, the European Commission gave its authorisation today to the European telecommunications alliance between France Telecom (FT) and Deutsche Telekom AG (DT), known as Atlas, and to the global alliance between Atlas and Sprint Corporation, recently renamed GlobalOne.
