This activity shall not include: (a) flights performed exclusively for the transport, on official mission, of a reigning Monarch and his immediate family, Heads of State, Heads of Government and Government Ministers, of a country other than a Member State, where this is substantiated by an appropriate status indicator in the flight plan (b) military flights performed by military aircraft and customs and police flights (c) flights related to search and rescue, fire-fighting flights, humanitarian flights and emergency medical service flights authorised by the appropriate competent authority (d) any flights performed exclusively under visual flight rules as defined in Annex 2 to the Chicago Convention (e) flights terminating at the aerodrome from which the aircraft has taken off and during which no intermediate landing has been made (f) training flights performed exclusively for the purpose of obtaining a licence, or a rating in the case of cockpit flight crew where this is substantiated by an appropriate remark in the flight plan provided that the flight does not serve for the transport of passengers and/or cargo or for the positioning or ferrying of the aircraft (g) flights performed exclusively for the purpose of scientific research or for the purpose of checking, testing or certifying aircraft or equipment whether airborne or ground-based (h) flights performed by aircraft with a certified maximum take-off mass of less than 5 700 kg (i) flights performed in the framework of public service obligations imposed in accordance with Regulation (EEC) No 2408/92 on routes within outermost regions, as specified in Article 299(2) of the Treaty, or on routes where the capacity offered does not exceed 30 000 seats per year (j) flights which, but for this point, would fall within this activity, performed by a commercial air transport operator operating either:

Whereas, in some Member States, the taking up and pursuit of the activities of architect are by law conditional upon the possession of a diploma in architecture; where, in certain other Member States where this condition does not exist, the right to hold the professional title of architect is none the less governed by law; whereas, finally, in some Member States where neither the former nor the latter is the case, laws and regulations are being prepared on the taking up and pursuit of these activities under the professional title of architect; whereas, therefore, the conditions under which such activities may be taken up and pursued in those Member States have not yet been laid down; whereas the mutual recognition of diplomas, certificates and other evidence of formal qualifications presupposes that such diplomas, certificates and other evidence of formal qualifications authorize the taking up and pursuit of certain activities in the Member State of issue; whereas, therefore, the recognition of certain certificates under this Directive should continue to apply only in so far as the holders of such certificates will be authorized, in accordance with legal provisions still to be adopted in the Member State of issue, to take up activities under the professional title of architect;

Whereas the Tunisian Government has given an undertaking that all exports of wine to the Community will be effected only on the basis of a written contract under the supervision of the Office du Vin de Tunisie, a Government agency which will issue a registration certificate authorizing export only if the free-at-Community-frontier offer price is not lower than the reference price less customs duties actually levied;

WHEREAS THE SPANISH GOVERNMENT WILL ENSURE THAT ALL EXPORTS ARE ACCOMPANIED BY A LICENCE ISSUED BY THE EXPORT DEPARTMENT OF THE MINISTRY FOR FOREIGN TRADE ; WHEREAS THE GOVERNMENT OF THE SWISS CONFEDERATION WILL ENSURE THAT ALL EXPORTS IN EXCESS OF 1 HL ARE ACCOMPANIED BY A LICENCE ISSUED BY THE COMPETENT AUTHORITIES ; WHEREAS THE GOVERNMENT OF THE ARGENTINE REPUBLIC WILL ENSURE THAT EXPORTS TAKE PLACE ONLY ON PRODUCTION OF AN EXPORT LICENCE ISSUED BY THE NATIONAL WINE INSTITUTE ; WHEREAS MONIMPEX UNDERTAKES TO BE THE SOLE EXPORTER ON THE BASIS OF A WRITTEN CONTRACT ; WHEREAS THE GOVERNMENT OF THE REPUBLIC OF AUSTRIA HAS MADE KNOWN THAT THE PRICE LEVEL OF THE PRODUCTS IN QUESTION IMPORTED INTO THE COMMUNITY AND ACCOMPANIED BY AN EXPORT LICENCE ISSUED BY A CHAMBER OF COMMERCE WILL NOT BE LESS THAN THE REFERENCE PRICE ; WHEREAS THE GOVERNEMENT OF THE PORTUGUESE REPUBLIC WILL ENSURE THAT EXPORTS OF THE PRODUCTS IN QUESTION TO THE COMMUNITY WILL BE MADE , EXCLUSIVELY ON THE BASIS OF A WRITTEN CONTRACT , BY EXPORTERS AFFILIATED TO THE " GREMIO DO COMERCIO DE EXPORTACAO DE VINHOS " ; WHEREAS THE GOVERNMENT OF THE SOCIALIST REPUBLIC OF ROMANIA WILL ENSURE THAT EXPORTS OF THE WINES IN QUESTION ARE EFFECTED ONLY THROUGH THE STATE UNDERTAKING ROMAGRICOLA ; WHEREAS THE EXPORT OF WINE FROM THE REPUBLIC OF SOUTH AFRICA IS SUBJECT TO THE ISSUE OF AN EXPORT LICENCE BY THE " SEKRETARIS VAN LANDBOUW-EKONOMIE EN BEMARKING " ; WHEREAS THE GOVERNMENT OF THE SOCIALIST FEDERAL REPUBLIC OF YUGOSLAVIA WILL ENSURE THAT THE EXPORT DECLARATIONS FOR THE PRODUCTS IN QUESTION WILL BE ACCEPTED BY THE EXCHANGE CONTROL OFFICE OF THE NATIONAL BANK OF YUGOSLAVIA ONLY IF AUTHENTICATED BY THE FUND FOR PROMOTING THE PRODUCTION AND EXPORT OF WINE AND OTHER WINE PRODUCTS ;
