By order of 19 October 2012, adopted under Article 44(2) of the Rules of Procedure, the Tribunal ordered the Commission to send it the version of the subject used in the applicant’s case study, and two other versions used in the competition, namely the one in respect of which the average mark awarded to the candidates was highest and the one in respect of which the average mark awarded to the candidates was lowest.

1 By their appeal the companies Diy-Mar Insaat Sanayi ve Ticaret Ltd Sirketi and Musa Akar ask the Court to set aside the order of the Court of First Instance of the European Communities of 17 January 2007 in Case T‑129/06 Diy-Mar Insaat Sanayi ve Ticaret and Akar v Commission, not published in ECR, (‘the order under appeal’) dismissing as inadmissible their action which sought, first, annulment of the decision of the Commission MK/KS/DELTUR/(2005)/SecE/D/1614 of 23 December 2005 relating to the award of public works contracts for the construction of educational facilities in the provinces of Siirt and Diyarbakir (‘the contested decision’), and, secondly, suspension of the operation of the award procedure in question.
Par leur pourvoi, les sociétés Diy-Mar Insaat Sanayi ve Ticaret Ltd Sirketi et Musa Akar demandent l’annulation de l’ordonnance du Tribunal de première instance des Communautés européennes du 17 janvier 2007, Diy-Mar Insaat Sanayi ve Ticaret et Akar/Commission (T‑129/06, non publiée au Recueil, ci-après l’«ordonnance attaquée»), par laquelle celui-ci a rejeté comme irrecevable leur recours tendant, d’une part, à l’annulation de la décision MK/KS/DELTUR/(2005)/SecE/D/1614 de la Commission, du 23 décembre 2005, relative à la passation du marché public de travaux relatif à la construction d’établissements d’enseignement dans les provinces de Siirt et de Diyarbakir (ci-après la «décision litigieuse»), et, d’autre part, au sursis à l’exécution de la procédure de passation en cause.

– (FR) Mr President, we are dealing with a text which, from a technical and legal point of view, is of great practical importance, because it is actually about preserving the possibilities for recourse for candidates for public contracts by establishing a period suspending the awarding of the contract, in other words a period between the contract being awarded and the contract being signed, in order to enable unsuccessful candidates to lodge an appeal, in the knowledge that it is much better to try to object to a contract being signed than to win damages once the contract had been signed. This proposal also establishes effective measures for combating the illegal direct awarding of contracts.
- Monsieur le Président, nous avons là affaire à un texte qui, sous un aspect technique et juridique, revêt une grande importance pratique, puisqu’il s’agit en fait de préserver les possibilités de recours des candidats à l’obtention d’un marché public en instaurant un délai suspendant l’attribution du marché - soit un délai entre l’attribution du marché et la signature du contrat -, de manière à permettre aux candidats malheureux d’introduire un recours, sachant qu’il est beaucoup plus utile de tenter de remettre en cause la signature d’un marché que d’obtenir des dommages et intérêts une fois ledit marché signé. D’autre part, cette proposition prévoit des mesures efficaces pour lutter contre la passation illégale de marchés de gré à gré.

(9) In order to promote the free movement of workers, freedom of establishment and the free provision of services, while ensuring an adequate level of qualification, various professional associations and organisations have established common platforms at European level under which professionals meeting a number of criteria relating to professional qualifications are awarded the right to bear the professional title awarded by those associations or organisations.
Afin de favoriser la libre circulation de travailleurs, la liberté d'établissement et la libre prestation de services, tout en garantissant un niveau adéquat de qualification, diverses associations et organisations professionnelles ont mis en place, au niveau européen, des plates-formes communes, en vertu desquelles les professionnels répondant à un ensemble de critères concernant la qualification professionnelle se voient reconnaître le droit de porter le titre professionnel délivré par lesdites associations ou organisations.

At the time, the Greek authorities informed the Commission of their intention to carry out legislative reform and introduce the use of a mathematical formula in order to identify artificially low tenders for the award of public contracts.
La Commission avait été à l'époque informée par les autorités grecques de leur intention de procéder à une réforme législative introduisant l'application d'un système de formule mathématique pour la détection des offres anormalement basses lors de l'attribution des marchés publics.

(12) It is necessary to provide more information on the label about the reasons for the award in order to assist consumers in understanding the significance of the award.

(6) It is appropriate that, for a limited period of not more than 18 months, both the new criteria and the criteria established by Decision 1999/476/EC should be valid concurrently, in order to allow sufficient time for companies that have been awarded or that have applied for the award of the eco-label for their products prior to the date of application of this Decision to adapt those products to comply with the new criteria.
(6) Il convient que les nouveaux critères et les critères établis par la décision 1999/476/CE soient valables simultanément pendant une période limitée à dix-huit mois afin que les sociétés qui ont obtenu ou demandé le label écologique pour leurs produits avant la date d'application de la présente décision disposent d'un délai suffisant pour mettre ces produits en conformité avec les nouveaux critères.

(6) It is appropriate that, for a limited period of not more than twelve months, both the new criteria established by this Decision and the criteria established by Decision 1999/568/EC should be valid concurrently, in order to allow sufficient time for companies that have been awarded or that have applied for the award of the eco-label for their products prior to the date of application of this Decision to adapt those products to comply with the new criteria.
(6) Il convient que les nouveaux critères établis par la présente décision et ceux établis par la décision 1999/568/CE soient valables simultanément pendant une période limitée à douze mois afin que les sociétés qui ont obtenu ou demandé le label écologique pour leurs produits avant la date d'application de la présente décision disposent d'un délai suffisant pour mettre ces produits en conformité avec les nouveaux critères.
