The Consiglio de Stato (Italian Council of State), before which the case was brought in last instance, seeks to ascertain from the Court of Justice, in essence, whether EU law precludes national legislation which permits the conclusion, without an invitation to tender, of a contract by which two public entities set up between them a form of cooperation such as that at issue.

We have before us legislation wherein the ideas or principles of accountability and transparency are good and there are many first nation leaders who would support the need for transparency and accountability, but the real question is why the government once again ignored the need to work with first nation leaders to bring legislation, based on that sense of co-operation, forward in the House of Commons.

Anita Neville: With regard to criminal law amendments contained in legislation introduced in the 40th Parliament, Third Session, namely Bill C-4, An Act to amend the Youth Criminal Justice Act and to make consequential and related amendments to other Acts, Bill C-16, An Act to amend the Criminal Code, Bill C-17, An Act to amend the Criminal Code (investigative hearing and recognizance with conditions), Bill C-21, An Act to amend the Criminal Code (sentencing for fraud), Bill C-23A, An Act to amend the Criminal Records Act, Bill C-23B, An Act to amend the Criminal Records Act and to make consequential amendments to other Acts, Bill C-30, An Act to amend the Criminal Code, Bill C-39, An Act to amend the Corrections and Conditional Release Act and to make consequential amendments to other Acts, Bill C-48, An Act to amend the Criminal Code and to make consequential amendments to the National Defence Act, Bill S-6, An Act to amend the Criminal Code and another Act, and Bill S-10, An Act to amend the Controlled Drugs and Substances Act and to make related and consequential amendments to other Acts: (a) was a gender-based analysis of the impacts of the proposed amendments undertaken before the legislation was introduced in Parliament; (b) if yes to question (a), (i) when was this analysis conducted, (ii) by whom was the analysis conducted, (iii) which indicators were used to determine the gender-based impact of the legislation, (iv) what was the conclusion of the analysis regarding the gender-based impacts of the proposed amendment; (c) if no to question (a), (i) does the government intend to undertake a gender-based analysis of the amendments, (ii) when will this analysis take place; and (d) did the Treasury Board Secretariat require that a gender-based analysis of the legislation be completed before the bill was introduced in Parliament?

F. whereas the principle of equality before the law requires that Union citizens should enjoy equality in respect not only of European Union legislation but also of the national legislation transposing it; whereas it would therefore be highly expedient if, on expiry of the deadlines for transposing the European legislation, the Member States not only included an explicit reference in the transposition provisions but also indicated in their Official Journals which national provisions are intended to apply the legislation in question and which national authorities are responsible for their implementation,

We therefore saw it as all the more important that appropriate minimum guarantees be incorporated at European level before national legislation – over which we have no influence – went much further than the present proposal.

- The second proposal is that there should be a five-year time-bar on the recovery of sums owed to the Community. This limit could be extended in cases where active steps are being taken to secure recovery. As things stand, there is no general time-limit of a ‘Community’ nature (such a limit exists in certain sectoral regulations e.g. those concerning the Staff Regulations: 5 years, the regulation on the protection of the communities’ financial interests: 4 years). However, there is interference with the national legislation, where the contract refers to national law or where the judge is a national one applying his own law as the law of procedure. This could give rise to total chaos in those Member States where institutions’ right to collect debts is time-barred (after 3 or 10 years), or where, quite simply, no information is given on whether the deadline has lapsed until the case comes before the judge. Nor is it clear whether after the period has elapsed it is possible to accept compensation or spontaneous payment by the debtor. In brief, this proposal would introduce legal certainty for both the institutions and the debtors.
- La seconde consiste à prévoir un délai de prescription de cinq ans pour le recouvrement des créances communautaires -ce délai pouvant éventuellement être prolongé en cas de poursuites actives en vue du recouvrement: à l'heure actuelle, il n'y pas de délai général de prescription "communautaire" ( il y a un délai dans certains règlements sectoriels, par exemple en ce qui concerne le statut: 5 ans, le règlement PIF, protection des intérêts financiers: 4 ans, mais il y a interférence avec les droits nationaux applicables, car le contrat fait référence à ce droit national ou parce que le juge saisi est un juge national qui applique sa propre loi comme loi de procédure. Ceci aboutit à une cacophonie épouvantable dans certains États membres où la créance des institutions est prescrite après 3 ou 10 ans, ou encore l'on est simplement maintenue dans l'ignorance quant à savoir si la créance est prescrite, avant d'en saisir le juge. On ne sait pas non plus si après la prescription on peut encore compenser ou accepter un paiement spontané du débiteur. Bref, la proposition introduit de la sécurité pour les institutions et pour les débiteurs.

4. Welcomes the fact that the Commission takes account of the objectives of the Lisbon Agenda before proposing that a legislative proposal should be withdrawn; regrets therefore that the Commission has withdrawn the proposal for a directive on the Statute for a European mutual society despite the fact that it is one of the key elements of the Lisbon Strategy; expresses its surprise that the Commission adduces the diversity of national legislations as an argument against Community initiatives; calls on the Commission, therefore, to adopt an initiative before the end of the year to enable a Statute for a European mutual society and a European association to be drafted;
4. se félicite que la Commission tienne compte des objectifs de l'agenda de Lisbonne avant de proposer le retrait d'une proposition législative; regrette par conséquent que la Commission ait retiré la proposition de directive portant statut de la mutualité européenne qui constitue pourtant un des éléments clés de la stratégie de Lisbonne; s'étonne que la Commission avance l'argument de la diversité des législations nationales comme obstacle aux initiatives communautaires; demande en conséquence à la Commission de prendre une initiative avant la fin de l'année permettant l'élaboration d'un statut de la mutualité européenne et de l'association européenne;

The European Commission has decided to bring Belgium before the Court of Justice on account of national legislation which has the effect of hampering the marketing of wheelchairs manufactured in other Member States by imposing overly restrictive conditions on reimbursement under the national social-security scheme.
La Commission européenne a décidé de saisir la Cour de justice à l'encontre de la Belgique concernant sa législation qui revient à entraver la commercialisation de fauteuils roulants fabriqués dans d'autres Etats membres, en imposant des conditions trop restrictives pour leur remboursement dans le cadre du régime de sécurité sociale nationale.

Advocate General Geelhoed first points to the particular character of the case, inasmuch as the Court is being called on for the first time to rule on the admissibility of preliminary questions on the validity of a directive which have been raised by affected parties in proceedings before a national court before the directive has been implemented in national legislation.
