To that end, they shall endeavour, either in the framework of agreements concluded with neighbouring third countries or in the context of agreements on functional airspace blocks ð joint designations of functional airspace blocks or agreements on network functions ï , to extend the application ð further the objectives ï of this Regulation, and of the measures referred to in Article 3, to those countries.

5. In respect of functional airspace blocks established in accordance with Article 16 9a that extend across the airspace under the responsibility of more than one Member State, the Member States concerned shall jointly designate, in accordance with paragraph 1 of this Article, one or more air traffic service providers, at least one month before implementation of the airspace block.

In particular, the Member States concerned should jointly provide the information and accordingly provide one set of information and documentary evidence per functional airspace block.

Therefore, unilateral or reciprocal specialisation agreements as well as joint production agreements including certain integrated commercialisation functions such as joint distribution are covered by the Specialisation Block Exemption Regulation if they are concluded between parties with a combined market share not exceeding 20 % in the relevant market or markets, provided that the other conditions for the application of the Specialisation Block Exemption Regulation are fulfilled.

In respect of functional airspace blocks established in accordance with Article 9a that extend across the airspace under the responsibility of more than one Member State, the Member States concerned shall jointly designate, in accordance with paragraph 1 of this Article, one or more air traffic service providers, at least one month before implementation of the airspace block.

(9) In order to guarantee the maintenance of effective competition during joint exploitation of the results, it is necessary to provide that the block exemption will cease to apply if the parties' combined shares of the market for the products arising out of the joint research and development become too great. However, it should be provided that the exemption will continue to apply, irrespective of the parties' market shares, for a certain period after the commencement of joint exploitation, so as to await stabilization of their market shares, particularly after the introduction of an entirely new product, and to guarantee a minimum period of return on the generally substantial investments involved.
(9) considérant que, pour garantir le maintien d'une concurrence effective en cas d'exploitation en commun des résultats, il est nécessaire de prévoir que l'exemption par catégories cessera de s'appliquer à ce stade lorsque les parts de marché détenues par les parties pour les produits issus de la recherche et du développement en commun deviennent trop importantes ; qu'il est toutefois opportun de prévoir que l'exemption continuera de s'appliquer, sans prise en considération des positions des parties sur les marchés précités, durant une certaine période après le début de l'exploitation en commun pour permettre d'attendre, notamment après l'introduction d'un produit entièrement nouveau, une stabilisation de leurs parts de marché et pour garantir une durée d'amortissement minimale aux investissements importants généralement engagés;
