Although the Community has contributed to road safety over very many years, in particular through more than 50 technical standardisation directives, and despite the fact that the Maastricht Treaty clarified the legal means available to the Community to establish a framework and to act, [2] the Member States have been highly reluctant to take action at Community level, witness the harmonisation of blood alcohol limits which has been under discussion for twelve years.

Provided that this complies with the right to a fair trial, the following situations do not constitute a deprivation of liberty within the meaning of this Directive: identifying the suspect or accused person; determining whether an investigation should be started; verifying the possession of weapons or other similar safety issues; carrying out investigative or evidence-gathering acts other than those specifically referred to in this Directive, such as body checks, physical examinations, blood, alcohol or similar tests, or the taking of photographs or fingerprints; bringing the suspect or accused person to appear before a competent authority, in accordance with national law.

First and foremost, with regard to road checks, in the recommendation of 6 April 2004, the Commission pushed to intensify random checks on blood-alcohol levels through an effective device to measure alcohol in blood through an analysis of exhaled air, to be used in those places and at the times in which excessive consumption of alcohol by drivers is regularly observed.

Other measures in particular include the promotion of measures to reduce the road accidents caused by alcohol abuse, for instance by stepping up checks on drink-driving, disseminating tests enabling people themselves to monitor their blood alcohol content, offering incentives for ‘designated-driver’ programmes, lowering admissible blood alcohol contents and introducing harsher penalties for drink-drivers.

The Council would like to point out that, from a general point of view, in the conclusions that the Council adopted after its meetings of 4 and 5 April 2001 on a recommendation from the European Commission on the maximum permitted blood-alcohol content for drivers of motorised vehicles, the Council encouraged the Commission to monitor closely and evaluate the effects of its recommendation for a period of three years, paying specific attention to the proposals in the recommendation on legal blood-alcohol content and, if appropriate, submit new legislation in that respect.

4. Believes that an EU recommendation on blood alcohol limits is not the appropriate response to the need to reduce the considerable differences between the Member States in this field and takes this opportunity to reconfirm Parliament's support for the existing proposal for a maximum common limit of 0.5 parts per thousand; calls on the Member States to enforce compliance of the blood alcohol limits more strictly and reconfirms the need for provisions for the standardisation of apparatus for testing alcohol levels; considers that research and development of alcohol interlock devices should also be promoted;
