IN-CONTEXT TRANSLATIONS

At the November 2002 meeting of the World Trade Organisation (WTO) Committee on Sanitary and Phytosanitary Agreement (SPS), the US, Canada, Argentina and the Philippines again raised their concerns regarding the EU's continued handling of the approval of new GMOs and on the WTO compatibility of new and forthcoming European legislation, namely the Commission proposals on the traceability and labelling of GMOs and on GM food and feed.

Under the agreement, Canada and Korea will establish a new bilateral sanitary and phytosanitary measures committee through which experts can collaborate and consult on sanitary and phytosanitary measures to enhance bilateral co-operation and facilitate trade by discussing issues before they become problems.

Welcomes the fact that the EU has started to incorporate animal welfare into bilateral agreements with third countries (e.g. Chile and Canada); considers that all current and future bilateral agreements with third countries which address sanitary and phytosanitary measures should establish objectives both to ensure that animal products from third countries are produced at least to standards of animal welfare comparable with those of the EU, and that those standards are communicated to the European consumer;

Recommendation 2: That Canada and its North American partners use the lessons learned from the BSE crisis and the OIE recommendations to enhance the harmonization of their sanitary and phytosanitary standards and, to this end, that they set up a permanent NAFTA agricultural secretariat with the mandate to use these standards and generate reports including recommendations for actions by NAFTA partners to regulate the trade flow when a sanitary or phytosanitary issue occurs.

(3) In the light of the results of a dispute settlement case brought before the World Trade Organisation (WTO) by the United States of America and by Canada (the Hormones case) and recommendations made in that respect by the WTO Dispute Settlement Body on 13 February 1998, the Commission immediately initiated a complementary risk assessment, in accordance with the requirements of the Agreement on the Application of Sanitary and Phytosanitary Measures (WTO-GATT) as interpreted by the Appellate Body in the Hormones case, of the six hormonal substances (oestradiol 17β, testosterone, progesterone, trenbolone acetate, zeranol and melengestrol acetate) whose administration for animal growth promotion purposes is prohibited by Directive 96/22/EC.

The EU and Canada also signed three bilateral agreements covering veterinary matters, including sanitary rules for trade in live animals and animal products, an expansion of the scope of the existing Science and Technology Agreement and an Agreement on Nuclear Research Cooperation.
