The European Commission has decided to open the formal State aid investigation procedure according to Art. 88 (2) of the EC Treaty as concerns aid to the restructuring of Schmitz-Gotha Fahrzeugwerke GmbH and Gothaer Fahrzeugtechnik GmbH, both located in Gotha (Thüringen), Germany.
La Commission européenne a décidé d'ouvrir la procédure formelle d'examen des aides d'État prévue par l'article 88, paragraphe 2, du traité CE, à propos des aides à la restructuration accordées à Schmitz-Gotha Fahrzeugwerke GmbH et Gothaer Fahrzeugtechnik GmbH, deux entreprises situées dans la ville allemande de Gotha (Thuringe).

Schmitz-Gotha Fahrzeugwerke GmbH develops and manufactures trailers and semi-trailers, bodywork and chassis. In 1999 it had 239 employees, however it cannot be regarded as SME. The restructuring to be evaluated by the Commission started at the end of 1997 and the undertaking's long-term viability was to be established in 2000.

The aid subject to investigation, paid after 1 January 1997, amounts in the case of Schmitz-Gotha Fahrzeugwerk to DEM 9.3 million (Euro 4.755 million), and in the case of Gotha Fahrzeugtechnik to DEM 9.765 million (Euro 4.993 million. The reasons for the opening of a formal probe are the Commission doubts as to the compliance with the requirements laid down in the Community Guidelines on State aid for rescuing and restructuring firms in difficulties.
Ces aides, qui ont été versées après le 1er janvier 1997, s'élèvent à 9,3 millions de DEM (4,755 millions d'euros) pour Schmitz-Gotha Fahrzeugwerk et à 9,765 millions de DEM (4,993 millions d'euros) pour Gotha Fahrzeugtechnik.
