(80) This Regulation respects fundamental rights and observes the rights and principles enshrined in the Charter of Fundamental Rights of the European Union, notably Article 8 (the protection of personal data), Article 11 (freedom of expression and information), Article 16 (freedom to conduct a business), Article 21 (non-discrimination) and Article 38 (consumer protection).

This Regulation respects the fundamental rights and observes the principles recognised in particular by the Charter of Fundamental Rights of the European Union and notably consumer protection, the freedom to conduct a business, the right to remedy and to a fair trial, and the protection of personal data as well as access to services of general economic interest.

In line with the Charter of Fundamental Rights of the EU, this proposal seeks to ensure a high level of human health protection (Article 35 of the Charter) and consumer protection (Article 38) by assuring a high level of safety of consumer products made available on the Union market.

5.4. The ESC also welcomes the MERCOSUR presidential declaration of fundamental consumer rights, adopted on 15 December 2000, in which the signatory states commit themselves to a series of fundamental rights, such as the right to life, health, and consumer and environmental safety; the provision of public and private services and products under suitable and safe conditions; easier access to judicial and administrative bodies for the protection of individual and collective consumer rights.
5.4. Par ailleurs, le Comité accueille favorablement la Déclaration présidentielle concernant les droits fondamentaux des consommateurs du Mercosur approuvée le 15 décembre 2000, dans laquelle les États s'engagent à respecter une série de droits fondamentaux: droit à la protection efficace de la vie, de la santé et de la sécurité du consommateur et de l'environnement; fourniture de services publics et privés et de biens dans des conditions appropriées et sûres; amélioration de l'accès aux organes judiciaires et administratifs pour la protection des intérêts individuels et collectifs des consommateurs.

(17) Whereas the principles set out in Articles 8 and 10 of the European Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950 apply; whereas the consumer's right to privacy, particularly as regards freedom from certain particularly intrusive means of communication, should be recognized; whereas specific limits on the use of such means should therefore be stipulated; whereas Member States should take appropriate measures to protect effectively those consumers, who do not wish to be contacted through certain means of communication, against such contacts, without prejudice to the particular safeguards available to the consumer under Community legislation concerning the protection of personal data and privacy;
